Dd been sacked for isolating

My 16yr old has a part time job. Me and her dad had tests earlier this week. Unfortunately she was supposed to work so had to call in and say she couldn't.
Today she gets a text saying she's let them down! She's replied and said she can prove the tests were genuine and she had to isolate by law but they've not replied. This isn't bloody right is it?

Is the job off the books or PAYE?

slashlover · 23/01/2021 17:24

When did she phone and when was her shift @ShittingHell ?

Bunnybigears · 23/01/2021 17:28

Has she actually been sacked though? Was she zero hours contract?

ShittingHell · 23/01/2021 17:33

It's a takeaway place. They speak English as a 2nd language so texts are short and abrupt. Dd thinks it strongly suggests they don't want her to go back.
She gave them over half a day notice she couldn't go in. We tested negative so it was literally just that day.
She's been in to speak to them but the boss wasn't in. He's apparently going to call her later.

I hope she hasn't been sacked, S.hell. They are very mean if that is the case. Please let us know what her boss says when he rings.

SmidgenofaPigeon · 23/01/2021 17:36

Well over half a day l’s notice will be practically no notice for somewhere like that. Is that the maximum she could have given?

Still they haven’t said they’ve sacked her, gave they? Strongly suggesting is not sacking.

ShittingHell · 23/01/2021 17:38

She gets paid cash, no contract! Just as and when needed. We started feeling unwell the day before but that night I had a temp so booked a test as soon as I woke up. At that point I didn't know she was due to work. She told them late morning and was due in early evening.

Cash in hand then nothing can be done unfortunately.

SmidgenofaPigeon · 23/01/2021 17:39

IF they’ve sacked her.

slashlover · 23/01/2021 17:40

Does she only work one day per week? How long has it been since she was off if she's been in to see them?

oakleaffy · 23/01/2021 17:40

Paid cash, no contact...

Nothing can be done.

What an exploitative place.

Sounds highly unlawful. Report to Inland Revenue/Trading standards? Also Environmental Health, given that they are pressurising staff to come in even when potentially infectious.

So a really irresponsible thread title then 🙄
icelollycraving · 23/01/2021 17:46

Not a lot of notice. The perils of cash in hand casual work. They feel let down but I don’t think they have sacked her, they just don’t give her anymore work.

InFiveMins · 23/01/2021 17:54

Does she really need the job? I wouldn't want to work for employers like that.

BingBongToTheMoon · 23/01/2021 17:56

Why the Hell did she go in to see them?
Thought she was isolating!

Sally872 · 23/01/2021 17:57

She is 16!!! Explain to your child "let down" does not mean sacked. Ffs.

SmidgenofaPigeon · 23/01/2021 17:58

I’m guessing since it’s Saturday and presumably a busy night there, if she’s not been asked to work she assumes she’s been let go? Misleading thread title though.

WhenISnappedAndFarted · 23/01/2021 17:59

I've never worked in a takeaway however I have in pubs and restaurants and that would be incredibly short notice and I can see why they felt let down even though it's not her fault.

Your timeline didn't quite make sense to me, it sounded like you became ill earlier on in the week and she only told them today that she couldn't come in.

Wait and see what the boss says, but I don't think there's much you can do with a cash in hand job and no contract.

violetcobra · 23/01/2021 17:59

What a horrible situation for your DD.

I would seriously consider reporting her employers to the relevant authority (I'm afraid I don't know the details, but there's definitely an option to report unethical work standards).

Does the takeaway place have any social media presence / possibility to leave feedback? Regardless of whether she's been fired or not, treating an employee with such rudeness and disregard for public health isn't acceptable - I would look into submitting (a) public complaint(s).

Please do pursue this. They're putting employees and customers in a dangerous situation.

WorraLiberty · 23/01/2021 18:00

@BingBongToTheMoon

Why the Hell did she go in to see them? Thought she was isolating!
Because the tests were negative.
BingBongToTheMoon · 23/01/2021 18:04

Sorry @WorraLiberty where does it say they were negative?

BingBongToTheMoon · 23/01/2021 18:05

@WorraLiberty. never mind....I just saw.

Iminaglasscaseofemotion · 23/01/2021 18:08

@bloodyhairy

I didn't think she had to isolate unless you had a positive result.
Why would you think that? Surely even if you don't know the guidelines, or law by now (which is ridiculous if you dont) then surely common sense would tell you that you shouldn't go out and mix with people of someone in your household has symptoms.

Honestly, how do people not know this by now!

That was earlier in the week wasn't it. So she's no longer isolating.

If you booked the tests in the morning and she phoned them that morning, then it doesn't sound like she could have given them much more notice.
