To expect an Etsy refund?

CisMyArse · 29/12/2020 23:29

Bought 3 items from a 5* rated seller - beautiful pics, great reviews, cost £30 so while not breaking the bank, it's still £30!

I've seen the products I've bought being sold on Shein (FFS) for £2.99, £1.99 and £0.99. It is without any doubt, the same products. 100% certain.

AIBU to expect a full and utter refund? While I don't want to take down someone's possible livelihood, I do feel a bit miffed.

Depends on their returns policy or if they have a price match guarantee. There is no law against marking up products higher than a competitor or reselling items for a profit.
I’d be miffed too and the Etsy seller is clearly profiteering, but caveat emptor applies here.

Nicknacky · 29/12/2020 23:36

Why should you get a refund? You were happy with the price and willingly paid it.

Although I’m struggling to imagine a 99p product that you paid £30 for....

SomethingsGottaChange · 29/12/2020 23:37

No, you arent entitled to a refund

Alot of people do this!

WhereverIGoddamnLike · 29/12/2020 23:40

Have the listed the item aa handmade? If so, then report them to Etsy.

When you're selling on Etsy, they are very clear on how you can classify your products. If you use substantial components which you buy in then you need to include your supplier as a partner etc.
Loads of sellers do not do this, but if they are simply buying wholesale and then selling the product as it is but they've described it as handmade then report them to etsy. You can also return them and get a refund anyway.

zigzagbetty · 29/12/2020 23:41

Are you sure that shein haven't lifted the pictures from etsy and are selling poor imitations? I bought a piece of jewellery from them recently as it was lower than etsy and it was a poor mass produced replica, which wasn't surprising as it was a tenth of the price

WhereverIGoddamnLike · 29/12/2020 23:43

Etsy have a "not aa described" complaint function which allows you to open a case against the seller. If they have described these as handmade by them, then they are not as described. If the seller does not agreed to refund you then you can open a case.

sneakysnoopysniper · 29/12/2020 23:45

You sound like a bit of a low baller/bottom feeder.

Etsy sells handmade and vintage - plus vintage supplies. There is no set price for these items. You sell them for what the market will bear. I no longer sell on Etsy. Ive had Ebay bottom feeder buyers contact me and say "I can get this for 50% off from XXX. Will you price match?" I tell them to buy it from XXX before the seller runs out of the item. Then I block them.

ButtWormHole · 29/12/2020 23:45

You are due a refund from what was once called the distance selling regulations.

But also, only handmade and digital products can be sold on Etsy, or supplies. If not then they can be reported.

OnceUponAMidnightBeery · 29/12/2020 23:46

Why would you be entitled to a refund? You should have looked about first Confused There’s a lot of stuff on eBay you could buy cheaper new

Try ordering the cheaper product and I bet it’s not what arrives.

Do your own research next time?

CisMyArse · 29/12/2020 23:46

Thanks all.
Yes - they're described as handmade so I'll chase up a refund.
For clarity, the total amount for 3 items was £30, not £30 per item.

The pics are beautiful and I'd probably be more than willing to keep them should they came as described, but now I have them, they look naff and cheap.

My 12 yr old DD spotted them on Etsy yesterday - then it all made sense.

How do you know Shein hasn't copied them?

ChippyTea16 · 29/12/2020 23:50

Is it not more likely shein has used the Etsy sellers pics? Or do the products not look like what the Etsy seller was showing on their page?

Nicknacky · 29/12/2020 23:50

Even still, it totals £5.97. I struggle to think what could be mistaken for £30 worth on Etsy.

HeyMister · 29/12/2020 23:50

Have you received the product?
Same happened to me on Etsy and a few hours later I discovered the exact same product on Hobbycraft for £5.00 less, so I just asked the seller to cancel the order stating I'd ordered the wrong product.

WhereverIGoddamnLike · 29/12/2020 23:50

I dont know why everyone is saying that you are not entirely to a refund. Any seller on Etsy within the EU must follow the consumer rights act (directive of consumer rights) which means they must accept your return if you contact them within 14 days of receiving the item.
If they dont agree then etsy would step in and help, but in this case the item is not as described so etsy would step in anyway.

Not sure what happens on 1st of January with the EU and brexit stuff though.

Hippymama · 29/12/2020 23:51

Shein often lift pictures from Etsy, so the pictures your daughter saw on Shein may have been stolen from the seller you bought from.

WelcomeToGreenvale · 29/12/2020 23:54

Is it art? Shein are well known to steal artwork and sell it, often with filters, and at a far lower price. They steal photos of other items too, cushions, homewares, jewellery etc and you will receive an item of far lower quality if you buy it.

If you're buying from the original artist, then you pay what the art is worth. Shein are thieves and you can't trust that the photos they put up will be remotely similar to the item described.

CisMyArse · 29/12/2020 23:55

The actual products (all 3 of them) aren't as quality looking as the pics. I wasn't impressed when they arrived - the photography used is clever - soft lighting etc.

The Shein pics are of the exact same product but modelled differently so I know the pics aren't lifted.

It's sold as handmade. It's most definitely not.

Under current distance selling regulations, you've a right of return of anything that wasn't personalised by notifying of the fact you wish to return within 14 days of receipt. So send them back and you'll get a refund of the cost including postage that you paid (but not the cost to you of returning the goods)

WhereverIGoddamnLike · 29/12/2020 23:56

It is no longer called distance selling regulations. It is the consumer rights act. If you need to remind the seller, dont call it distance selling regulations. Call it the consumer rights act

CisMyArse · 29/12/2020 23:59

Thanks everyone.
I'm not after a cheap deal - I don't mind paying but not when it looks like something out of a Christmas cracker.

OP posts:
Notcontent · 30/12/2020 00:00

Sadly, while Etsy might have started off as an online marketplace for handmade and vintage products, a very large proportion of the products sold there now are just cheap mass produced items sold as being something else. I can see why this has happened - because hand made, quality items have to be expensive - but most buyers just want very cheap things.

WhereverIGoddamnLike · 30/12/2020 00:05

Etay also changed their mission statement a few years ago. Totally changed the tone of what their business was, what their priorities were.

So, while they still do make it clear to sellers what "handmade" must mean, they dont enforce it or stop the masses of people selling junk because they're no longer concerned with maintaining Etsy as a quality site. They will step in if a customer actually reports it and wants their money back, but it is very much a case of sellers get away with it as long as no one raises a fuss.

@Nicknacky

They weren't doing anything wrong; they don't owe anyone the same price as retail.
WhereverIGoddamnLike · 30/12/2020 00:16

If they've described it as handmade by themselves, then they have done something wrong.

People on here seem to have no idea about consumer law. Even if they items were exactly as described, you could still return them for a refund (as long as not personalised). If they're not as described then absolutely can return them without feeling any guilt about it.
