After all, if a Jaffa Cake were a biscuit, it would be called a Jaffa Biscuit.

Jaffa Cake = cake, vote yes

Jaffa Cake = biscuit, vote no

Didn't the judgement boil down to if it is originally soft and goes hard when it is 'off', then it's a cake.

If it is originally hard and goes soft when it is 'off', it's a biscuit.

It also amuses me that a plain Gingerbread has no VAT, however if he wears three (approx) chocolate buttons then VAT applies.

Just be glad you weren't asked about smoked salmon and kippers!

(FYI smoking salmon is zero rated as smoked salmon is classed as a new product. Smoking herring is standard rated as kippers are not classed as a new product - despite it having a different name. VAT rules are nonsensical)

Somone referred to the Jaffa Cakes VAT court case in the context of the difficulty of setting clear rules for people to follow, and she replied that she hadn't heard of the case but as far as she was concerned it's a biscuit.
