Colleague is blaming me for speeding fine

A few weeks ago I called a friend a colleague with a work related query and he answered while he was driving (handsfree). I didn't know he was driving - we work remotely at the moment.

A week later he received a speeding fine and he's looked at the call logs - it shows he was caught speeding 1 minute into our two minute phone call.

He is saying it's my fault as the call distracted him. It was a static speed camera, not a policeman - ie. the camera is always there and it's a route he takes every day.

I really don't think I'm responsible for his own mistakes.

Many years ago - about 2014 - I was on the M4 around 10am going between J15 and J13. All of a sudden the traffic started slowing down and bunching up. Eventually I passed the reason. A transit van doing 30 in the left hand lane where the driver was clearly busy on his phone and let the speed drift down.

It was one of the reasons I got a dashcam - with a rear facing one too, since I've lost count of the number of times I've looked in the rear view mirror in traffic to see a blue glow on someones crown.

If you were his manager or boss, and have pressured him to take calls while he's driving, only then would you bear a share of the responsibility.

Of course not. Any court of law would expect you, as the person in charge of the car, to ignore those calls.

You've still not said why you were driving over 80mph in a 60 zone - or why you thought it was acceptable.

Nope. Almost 30% over the speed limit, which still applies to you wherever you're going or what the road conditions are. Nowhere in the UK is 80mph 'appropriate'.

I also find taking calls while driving distracts me, that's why I don't do it! He is responsible for his own decisions.

What a total idiot. I had an ex who sued to blame me for fines. He was always doing things like parking on the pavement. Stupid ass.

Presumably it's not a disciplinary offence on a hands free if it's a work call, as OP's was?

At the company I work for, yes - even hands free would be a disciplinary as it's proven that it still affects concentration
We're not allowed to answer the phone while driving. Ever.

How on earth can you be responsible he didn’t have to answer the phone call or pull over to take it. Absolutely rubbish. They were driving their responsibility period.

He chose to answer or not answer, no one else is responsible. Would he say this to his boss, parents, spouse, dentist, GP?

A boy on a motorcycle crashed into me when he couldn't see because the sun was in his eyes. I was doing about 20mph around a corner in a housing estate, he left a junction and drove straight into my rear door as I passed. The police man agreed that the sun might have been to blame, but we can't claim off the sun. If a bumblebee had flown into his eye, we might have been able to claim off the bumblebee. Oh, no, wait. We can't claim off the bumblebee. Who can we claim off? The person who wasn't in control of their vehicle and caused the accident. This would have been your colleague. Nice try though!!
