Who was wrong here?

Person A is sat in car in ambulance bay outside hospital main entrance. Person B comes out main entrance holding hands with 2 children and walks behind car to cross the road. Small one-way road no cars coming. Person A reverses and almost hits one of the children but Person B pulls them back. Person A apologises but Person B doesn't respond but body language suggests they're not happy. Person A then changes to shouting at Person B for not using the crossing further down (the other way to where Person B was going) and drives away. Who is wrong? Should Person A have looked before reversing or should Person B have only crossed at the crossing?

Both at fault. A should have checked their mirrors before reversing. B should have had more sense than to cross behind a car with a driver sitting in it, especially when there’s a crossing further down. Having said that, in most cases the driver who took insufficient care with their two ton vehicle is generally considered to be at fault, and would probably have been prosecuted for dangerous driving if someone had been killed.

JE17 · 23/07/2020 10:30

Of course A is wrong for not looking when reversing. Doesn't matter if there was a crossing nearby, that doesn't negate the need to check mirrors.

KittyFantastico · 23/07/2020 10:31

The person in the car should have looked as the onus is on motorists to give way to pedestrians/check for pedestrians before maneuvering. They then acted like a dick with the shouting.

The crossing is irrelevant, it's possible to cross safely without one.

EnjoyingTheSilence · 23/07/2020 10:33

Person A shouldn’t have been parked in an ambulance bay and they should have checked before reversing. Person A is at fault

Atalune · 23/07/2020 10:33

Driver was wrong.

Cross was stupid to cross behind a parked car! That’s is not what the green cross code tells us.

Nonotthisagain · 23/07/2020 10:34

Person A of course.

contrmary · 23/07/2020 10:36

Both are wrong. Person A shouldn't have been in an ambulance bay and should have checked behind them. Person B shouldn't have been crossing behind a parked car. Person B could have accepted the apology more graciously and Person A shouldn't have shouted.

Both are to blame for the situation.

Boireannachlaidir · 23/07/2020 10:42

Person A should have looked before reversing. Especially at a hospital entrance.

Where the crossing is is irrelevant in this scenario.

OutOfHours · 23/07/2020 10:42

A

eurochick · 23/07/2020 10:48

A is completely in the wrong here

Bringmewineandcake · 23/07/2020 10:48

Person A

airo · 23/07/2020 10:49

Person A is wrong for being parked in a bloody ambulance bay firstly!

EL8888 · 23/07/2020 10:50

Why was person A sat in the ambulance bay is my first question. Person B should have been less lazy and walked to the crossing. But person A also should have looked in their mirrors before reversing, it is mirror / signal / manoeuvre after all

LemonTT · 23/07/2020 10:51

@airo

Person A is wrong for being parked in a bloody ambulance bay firstly!
Yes well I never got past that bit.

Both made mistakes. A more than B.

Whoever the poster is, they should stop dwelling and accept what they did wrong. Then move on. You don’t need a referendum.

dontdisturbmenow · 23/07/2020 10:54

Its amazing how some people when clearly in the wrong having endangered someone will put more energy trying to justify how it is the fault of the victim rather than apologising profusely.

Happens all the time.

Disfordarkchocolate · 23/07/2020 10:56

Person A totally. There is no requirement to use a crossing, there is to check it is safe to reverse your car. Anything could have been behind the car.

Nottobesoldseparately · 23/07/2020 11:01

Person A.

maxdash · 23/07/2020 11:04

Person A

MintyMabel · 23/07/2020 11:34

Unless person A was in an ambulance, they shouldn't have parked there.

Person A should have made sure the road was clear before reversing. Regardless of where there was a crossing, Person B was quite within their rights to be where they were. Person B could have been a child having run off, or any other vulnerable person.

Person A is clearly a twat.

lanthanum · 23/07/2020 11:53

A would be liable, but when B made the decision to cross there rather than at the crossing, they should have noted that the driver was in the car and been alert to the possibility of them reversing. A being legally liable doesn't make it much better if a child is injured.

Technically, if you step onto a zebra crossing when a car is approaching, it's their fault if they can't stop in time. However I hope that we all teach our kids to check what's approaching and that the drivers have seen them.

cathcath2 · 23/07/2020 12:07

A was in the wrong. However, assuming that both were visitors to the hospital, I imagine that both A and B were quite stressed so not at their best.

Stringsattached · 23/07/2020 12:34

Person A but crossing behind a car with two children is not sensible.

differentnameforthis · 23/07/2020 12:38

You should always look before you move your car.
You shouldn't be parked in an ambulance bay.

OscarWildesCat · 23/07/2020 12:43

A is in the wrong, you don’t reverse without checking mirrors but person B should also have really used the crossing with 2 small children.

TheTrollFairy · 23/07/2020 12:46

Person A is wrong as they are both parked in an ambulance bay and they didn’t check their mirrors. My driving lessons and test was years ago now but one of the first things you are taught is ‘mirrors, signal, manoeuvre’
Person B is also at fault as they crossed behind an occupied car when a crossing is usable but this is only a slight fault but the risk was greater to them so they should have checked. The blame really lies with Person A though.
