Taking shelves when moving house

We are due to move in a few months. We have long and quite expensive scaffold board shelving in our kitchen - AIBU to take it with us when we move?

Nope. I couldn’t risk the sale falling through so they got them. And when they sold a year later they had replaced them anyway!!

Bastards! Did the EA not give you an f&f form Nicknacky? We didn’t get one, not that there was anything worth keeping in the house we bought.

Cadent It was 10 years ago and to be honest I don’t think we do the fixtures and fittings forms in Scotland although I could be wrong as I haven’t sold since. I genuinely was going to use them in my new home as I loved them. I still have the pouffay in the same fabric😭

We were in a tricky position as we were buying a house at the same time so really really couldn’t risk the sale. I got £250 knocked off the fees though so that at least was something.

He was such a liar. Totally denied I told him even though I was clear about it but I never put it in writing so it was she said/he said.

I took light fittings, curtain poles, curtains and blinds. Also left some of those items and my lovely range cooker (that I miss but had too many memories of husband cooking at it). I was going to take my she shed but left it in the end as had no where to store it. I also took my marble fireplace surround.

Like others have said as long as the buyer is aware and its noted on the fixtures and fittings list then its fine.

I took out my solid wood kitchen and granite worktops before listing my house, I put in a lovely ikea kitchen so any buyer was happy to get a brand new kitchen. The old wall units stayed anyway as did the corner wooden breakfast bar next to the range cooker, glass splashback and really nice cooker hood.

My buyers were happy. And yes I did take all my fancy led and other eco light bulbs. Morning of completion I rushed to b&m and replaced all light bulbs throughout. Led can cost a fortune so why would I leave them for the buyer?

Still regret the pink she shed and range cooker but hey ho. The buyer was happy that his grandkids were getting a garden Playroom. These were not noted on the fixtures and fittings as leaving them but I spoke with the buyer 2 weeks before completion, he asked about them and I agreed verbally to leave them.

Take your shelves op, fill the form out correctly. There are some very entitled people on this thread but most are sane thankfully.

People can take carpets as long as it's detailed on the fixtures and fittings form and your buyers know. That's the point of the form. I don't know why people can't understand this.

And every buyer and seller is different, when buying I insist carpets are removed. My sellers refused and it delayed things by 3 weeks. I was adamant, please remove all carpeting in the house. No way could I have moved in and even doing a reno, it would be a massive job for me with allergies to remove and dispose of them. Even new carpets I would ask a them to remove so they should take them with them.

I'm not that unusual as many people I know either take carpets or ask for them to be removed.

Lots of people take sheds and detail it on the form or leave a shed and detail it on the form.

I would not leave light fittings or items I love but I would make sure that the buyer knows exactly what is being left.

I'm taking my current wooden floor but buyer will never know as I'll replace it with new carpet before I put the house up for sale. So many people don't like wooden floors upstairs anyways and prices for wood have gone up so much that I need it for my next house and carpet is so much cheaper.

@NickNacky your EA was a muppet, they should absolutely have gone through that. I've actually posted the text from the standard clauses upthread and it doens't include curtains (poles and blinds, not curtains) but my EA actually asked from outset and put in the particulars that the curtains weren't included. Similar situation here, I've got very nice large silk curtains which I have no intention of leaving behind!

Let your solicitor know and they can give your buyers the option to buy it if they want to keep it.

StatisticallyChallenged Oh I completely agree he was a muppet. I was told by him that I should be grateful he sold my house as quickly....I was as it was a tricky house but it didn’t mean I wanted to do it at the expense of my curtains!

Thankfully mine were on the ball with that from the start so it's even on the particulars!

That said...we've not concluded missives yet so lets hope they don't come looking for them. I've not long decorated the main room (before we decided to move) and I still absolutely love it so intend to do something very similar in new place. Replacing the curtains would be an expensive pain in the ass.

Totally fine. It's like taking curtains, light fittings or carpets.

When I bought my house I was surprised that the vendor had taken every shelf out of it, but of course, they had every right.

Scaffold board shelves that have been sanded and stained with a nice support do cost money - besides, the price is irrelevant. They belong to you!

I would definitely decorate so that the wall looks okay once the shelves have been removed.

Ironically the family is just about to sell my mother in laws house and we will probably go with the same guy as he is the busiest and most popular in my town.

OP I think you should tell your buyer directly that you wish to take this shelving. Confusion arises when there is no communication between the vendor and purchaser directly

If they are in the house when the purchaser views it, you must specify that you are removing them. Legally, they are otherwise part of the house

They belong to you!

Not if you've sold them to someone else, they don't. They are fixtures and unless you have specified that they aren't included, they are sold with the house.

Take the shelves and make sure wall is ok before you go. They’ll look good in the new house.

If the shelving is mentioned in your sales particulars then you would need to leave them, if not then you can take them

You’re definitely not being unreasonable if you haven’t done the fixtures and fittings list yet, if you have then you are.
People don’t expect everything to be left, shelving, curtain poles even fancy light fixtures can be taken (as long as those are replaced for something functioning) so you’d be fine. As long as they wouldn’t leave an issue with the actual kitchen. Maybe make good the walls to be nice.

Homes are sold including fixtures and fittings ie anything that is attached to the house. You can negotiate with the new owner to take them but it needs to be in the Contract of sale and any costs incurred to restore or repair any damage caused by taking them.
