Employer making life VERY difficult.

Supposed to be returning from MAT leave in June, have childcare arranged and as a key worker they will still take my baby - excellent.

Had a team meeting with work this week to discuss going back and have been told that I have to relocate as my partner works on the same site as me - which has been known since I informed them we were in a relationship, however the policy changed in October (before I went on MAT leave). While we are on the same site, our jobs are separate and we are working in different buildings, have different managers and different hours. The different hours means I will need to do drop offs and pick ups to coincide with opening and closing hours.

So during the middle of a pandemic, with child care mostly closed I now have to find a new nursery, lose a significant term time deposit and start the settling in process all over again. Not only that, they have told me to find my own employment within the company - my head is exploding with all of this. AIBU to think this is an unnecessary ball ache!

I appreciate that this is a minor problem given the amount of people losing jobs!

So sorry to hear the latest development - the lines are a bit blurred as from what I remember, parts of your grievance were about your line manager, and depending on your company's grievance procedures, they may be able to read it as it's a statement against them.

And arguably, the medical information would be relevant for your line manager to be able to manage you as they would need to make reasonable adjustments when you get back to work.

However, this needs to be balanced by the fact that your complaint is against your line manager, and while you may have a claim, the ICO would fine the company. You would need to first raise it with the Data Controller of your company as required by the GDRP legislation.

But just to recap, you were on maternity leave and all of the subsequent actions kicked off when you tried to return to your role which you had been performing satisfactorily prior to this, which needs to be repeated to the HR Bots in your company.

Oh my gosh OP, full credit to you for sticking to your guns. They sound like an absolutely awful employer. If you'd read this in a employment law update you'd assume it was an amalgamation of awful employers rather than one spectacularly terrible one.

Seek legal advice, as your employer is being very unreasonable. Sounds a bit like constructive dismissal.

Best of luck - try to keep calm and reiterate that you just want to get back to work in your job you had before you went on maternity leave.

And that all of the issues snow balled when you tried to return to work.

They will be squirming, believe me.

Meeting was a nice as it could be. However, it’s so big that they need to conduct a full investigation and that’s going to take some time. Well over the 15 days the policy states, in the meantime, I can’t return to work as I have no hours. The data breach has caused massive issues and it’s looking likely it will go down the tribunal route unless my line manager is removed from post. Not at all what I wanted but no idea how to move forward.

Union was a great help and I can’t recommend joining one enough!
