😩😭 Christmas Eve we were driving to mums and we stopped to get a McDonald’s Husband was inside ordering, I let both dogs out for a pee and as I walking in the car park someone reversed out of a space at speed so I jumped onto the grass slipped and landed with my left leg underneath me and I was sat on my knee, it definitely dislocated and I felt a snapping, it’s so tight and swollen.

It's got stiffer and stiffer over the 3 days, I can't put my foot on the floor fully as my calc is too tight, my back and upper side hurts because I'm walking like a weirdo.. everything hurts!

I should have gone to A&E but I really didn't want to, however now I regret it! I shouted at him from the floor covered in mud and god knows what, and he said 'sorry I thought it was in drive not reverse'

Is it his insurance or mine I claim on? Because I am hurt.

Also.. what the hell do I do with this leg? It's fucking useless! I can't bend it, I can't put my full weight on it, I can't straighten it fully, it's huge, I have tingly sensations on the opposite side to the swelling all the way down to my ankle, I have to walk upstairs with it kind of off the side and when I'm up and walking through the pain if I move in a funny way or try remotely to do anything exciting like a small bit of pivoting it feels like it's going to give way so I nearly fall over and jerk wildly grabbing at furniture.

It took me over an hour on Christmas Eve to get off the floor Blush

I think you could claim as yes it was an accident but that's the point of having insurance, for accidents. However I do think the longer you leave getting checked out the more credibility you lose. You really should get it looked at today if you're in so much pain, regardless of whether you claim or not.

OP left it for 3 days, a little bit more than 16 hours and says definitely dislocated.

She doesnt think it's a bad sprain.

Dislocated knee? Calling total bollocks.

If you had done that you wouldn't have gotten up from the mud. You wouldn't even be able to walk a little. You'd still be lying on the verge screaming your head off.

My Brother did that to his knee once, couldn't get up from the floor until the ambulance peeps had given him enough painkillers to knock out a herd of elephant. And you should have heard him scream A&E down when they had to get it back in! Holy crap it was awful!.

Sounds like you have pulled some muscles quite badly but if you had gone to A&E like a normal person [if the pain was that bad] they would have been able to tell you.

I've done this. Slipped at home and had to drag myself to sofa to get my phone. But then after lying there is screaming pain for 20 minutes I phoned 111 (instead of asking MN) and had to have an ambulance come over as I couldn't get off the floor. (had to drag self to front door like a crippled slug to let them in!)

Ended up with severely pulled muscles all on one side of the calf to the knee then knee to hip. (they did give it a name but can't remember) Was in there bloody hours in crippling pain but didn't mind as was then given lovely strong pain meds, had to stay in overnight as my leg was numb and swelling up and after lots of things pumped in me a couple of lovely ladies taught me how to walk and go up and down steps using crutches and what exercises to do to get my leg in working order again. Took about 6 months with physiotherapy to get ok again.

On the plus side it has now turned into Mystic Meg as it can predict cold weather fronts cos it starts to hurt before it turns cold! LOL

Good luck trying to sue someone for reversing in a car park. The mere fact you didn't take yourself off to A&E or the emergency docs will set off any insurers alarm bells that what happened wasn't that bad. Also CCTV might show how much attention you were paying to other cars in the car park, how close you were to the parked cars and how easily you would be seen by another driver etc etc...

For all we know you could have been rushing to get back to the car therefore poising a risk to other drivers and yourself.

So before you decide to go down the money route just beware they WILL check everything about you and will check for CCTV and they WILL rip you a new one for a) not seeking medical help immediately and b) if they find the TINIEST evidence you also weren't paying 100% attention.

I can't believe you think it's injured badly enough to claim and yet you haven't sought any medical advice. Surely if its that bad you would have had it looked at by now?

I have dislocated my knee 3 times, thanks to being hyper-mobile. TBH, it didn't really hurt but it was badly swollen afterwards.

If it was dislocated surely it would be a strange angle? And also how come you've not gone to A&E to have it put back into place if it was? There's no way you could have a dislocated knee and not get it treated for 2 days. I've only ever dislocated a thumb and you could tell by the weird angle it was dislocated and it was straight to A&E. Surely that's more important than claiming? Worry about that later!

Actually if you were thinking of claiming, if you've waited all this time to get medical help that would go against you, as his insurers would want evidence and they could say that an injury that wasn't diagnosed and treated straight away was not caused by the accident you claimed.

Dislocated? You'd have been in a&e that night. It's quite sad that instead of seeking medical treatment you are on the internet seeking advice on legal action.

Either your leg is bad or it isn't. Which one?

Given you've left it several days before seeking medical attention you're going to have a hard time proving it was the fall on Christmas Eve that injured your leg and not something you've done subsequently.

The thing is a lot of your problems are potnetially caused by your own negligence at not getting appropriate medical help.

I get you are in pain and angry, but part of that is due to your own actions. You have no idea how much damage may have been caused by not going to A&E, putting weight on your leg etc.

I think it says a lot that you think of claiming for your pain before seeking medical help. If it wasn't bad enough to go to a&e at the time, I think deciding now it's bad enough to claim is morally wrong, because it hasn't been causing enough impact on your life to bother seeking medical treatment

And yet there area always stories in the press with cars mounted on railings, hanging out of car parks, shooting through walls, shop fronts etc. It's not uncommon, regardless of difficulty.

To all the people saying pp has a claim. She could have actually done this. Saw a car reversing. Threw herself on the ground and is testing how likely she is to get some money

Go to a doctor or A&E about your leg (surgeries are open today), and after you get a diagnosis, contact your insurance company to find out if you have a claim against the driver.

It's very simple OP.

Putting it into drive is easy. Reverse not so much. Usually the ones that have tipped into reverse have an issue.

And again to reverse put of his spot forcing the OP on the verge he needs to have reversed a long way. No way did he not notice.

Last time I had a reasonably serious injury as a result of an accident (hit by a moped causing a wound serious enough to require 13 stitches) my first thought was ''go to A&E'' not ''I need to put a claim in''. As I suspect most people's thoughts would be.

I never bothered with a claim. Accidents happen. Plus I wasn't altogether blameless. I'd had a glass or two of wine and didn't look properly before stepping off the pavement.
