😩😭 Christmas Eve we were driving to mums and we stopped to get a McDonald’s Husband was inside ordering, I let both dogs out for a pee and as I walking in the car park someone reversed out of a space at speed so I jumped onto the grass slipped and landed with my left leg underneath me and I was sat on my knee, it definitely dislocated and I felt a snapping, it’s so tight and swollen.

It's got stiffer and stiffer over the 3 days, I can't put my foot on the floor fully as my calc is too tight, my back and upper side hurts because I'm walking like a weirdo.. everything hurts!

I should have gone to A&E but I really didn't want to, however now I regret it! I shouted at him from the floor covered in mud and god knows what, and he said 'sorry I thought it was in drive not reverse'

Is it his insurance or mine I claim on? Because I am hurt.

Also.. what the hell do I do with this leg? It's fucking useless! I can't bend it, I can't put my full weight on it, I can't straighten it fully, it's huge, I have tingly sensations on the opposite side to the swelling all the way down to my ankle, I have to walk upstairs with it kind of off the side and when I'm up and walking through the pain if I move in a funny way or try remotely to do anything exciting like a small bit of pivoting it feels like it's going to give way so I nearly fall over and jerk wildly grabbing at furniture.

It took me over an hour on Christmas Eve to get off the floor Blush

You don’t claim off anyone, you have just hurt your leg.

Go to the Dr or a walk in centre or A and E if it’s as bad as you say. If it was really that bad you would have done that already though, so I would say rest it for a bit and see what happens

Claim?! Confused I don't understand why you think you should?! Accidents happen.

Minor injuries unit or A&E if there isn't one within a reasonable distance of you.

You definitely need to go and get your leg checked out.

With regards to claiming, I'm not sure what you could claim for and what insurance you think would cover such a claim anyway!? You didn't go to A&E, you have no idea if you are actually injured, you haven't lost any earnings. It sounds like an accident, and you sound very grabby.

This thread won't go down well on MN OP. But you could look into claiming. You would have to be able to prove it was his fault (CCTV?) and loss of earnings, plus the injury itself may have a small compensation value. If you don't have his reg and/or details though I'm not sure there's much you can do.

I'm sorry you have hurt your leg and hope you recover soon.

However you can't make a personal injury claim against him. He didn't hit you and I don't think he was negligent in his actions. What happened was an accident.
Also, you would be claiming for your losses e.g. physio, loss of earnings etc. Have you suffered any?

Go to a&e. You may be at risk of dvt with an injury like that and also they will be able to give you the right treatment and pain killers.

Firstly you obviously need to get your leg checked out.

Do you have his details? Licence plate?
Do you think it was caught on cctv?
Will the injury result in loss of earnings?

It sounds like he was driving without due care & attention if he put the car in the wrong gear.
I have no idea if the fact it was in a car park not on a road will have any baring.
I thought you could claim for pain & suffering?

I thought this kind of thing is what insurance was for? Not sure why people are calling you grabby?

I wasn't walking them in a car park.. they needed a pee after being in the car for 2 hours, I was walking back to the car when he reversed at me at speed and I mean at speed and my only way of escaping him was diving onto the grassy verge. He hit the kerb hard enough to dent his bumper Hmm if he hadn't been in the wrong gear it wouldn't have happened. So yes I do feel he is at fault! If I hadn't moved onto the verge he would have hit me!

Yes I have his plate and he gave me his insurance info.

No @mothershipG this is what's wrong with insurance. People like this who aren't even injured enough to take themselves to urgent care / A&E to ensure they don't have any pain and suffering, and instead spend their time on MN finding out how they can scrounge some money out of the situation. OP admits she could've gone to A&E, but didn't want to. If the injury was so bad that it requires compensation, then it certainly should be bad enough that it requires medical care - but evidently it didn't. Because theres nothing wrong with her.

@youreaquizardharry - your leg is fine, stop being grabby

No advice re claiming because I think unless you have had some actual financial loss then you are obviously being grabby

You need to go and get your leg seen to. I would be more worried about this than making a claim from what you have described. If you do intend to claim, you will need a medical report anyway.

Not sure what you are claiming for, particularly at this point where theoretically you don’t have anything wrong with you as no one has diagnosed you with any problem. It all has to be pretty tangible now - lost earnings, out of pocket medical costs etc and any costs incurred in perusing it would probably be greater than what you would receive.

You sound like you may have ruptured your anterior cruciate ligament. It's a fairly classic description. Not sure what you want to claim for or how it was the drivers fault. Go see your GP and get a referral to physio, they will be able to tell you what's up and if surgery will help.

How strange that you won't go to hospital but you will attempt to 'sue' the driver for money. Perhaps you could buy a new leg with the proceeds.

Sorry but theres no way is dislocated and you havenr had to go to hospital.

If you genuinely thought is was dislocated, sht haven't you gone? They dont just pop back in.

Firstly you would need prove the converstation, how does the bumper get damaged by a kerb? The price it was that bad, despite not getting medical help.

Then accept some responsibility for how bad it's got. A dislocation only gets worse without medical help. This may not be this bad if you had done the denise thing
