To leave my job with one week notice

I have been at my job for just under 6 months and am still in the probation period, I’ve read my contract and I only have to give one weeks notice, which I did today as I have a new job . The reason I’m leaving is because there has been an affair going on between the boss and the woman I work with ( very small company only 6 of us) this has been brought into the work place , they have involved me ( one of the pair had another affair behind the others back , told me about it, I had to pretend I knew nothing about it, then that person (boss) found out and quizzed me , anyway it’s been intolerable.

The person that had another affair behind the bosses back was asked to leave and goes this week. Me resigning leaves them up the creek and they have said I have to give 2 weeks notice. My new company wants me to start on Monday along with another new person and I would like to start on the same day as they are.
AIBU to not work 2 weeks notice as they are asking?

Really don't feel bad. They have behaved badly and will have to deal with the consequences of that. You are behaving entirely within your rights and like any other normal person would in the circumstances.

That really is their issue and not yours.

They'll think badly of themselves. They're the ones that have caused this not you.

Please don't worry that they will think badly of you, or feel that you're letting them down. They've let you down with incredibly unprofessional behaviour. Behaviour which has made the working day intolerable for you and it really is you that should think badly of them. They didn't care about you and the impact their shenanigans had on you, did they? So why feel bad for them? You've given them all the notice that they asked for in your contract. You are doing nothing wrong or unprofessional, unlike them.

The XX employment law specialists who drew up that contract should have noticed that they are giving contradictory notice periods. The first page says during probation, one week notice. The second page says during probation, you're entitled to two weeks notice.

You give one weeks notice and start your new job next week.

@inboxmayhem, it states that the company can terminate her employment with one week's notice during probation, then states that during probation she is entitled to two weeks' notice.

Regardless, she's entitled to give one week's notice, it was just a side comment.

It doesn't inboxmayhem, she is entitled to one or two weeks' notice depending on which page you read. (Irrelevant here luckily as she is the one giving notice.)

Let them be pissed off. They drafted the contract. Just give one weeks notice... that place sounds awful. Good luck in your new role !

Why would you care what these degenerates think of you? You only have to give 1 week notice per your contract. You've done that and I would be telling them exactly what I think about their disgusting lack of professionalism.

I have told them exactly why I am leaving , they seem to think that because one half of the ‘couple’ has been told to leave , it isn’t a problem any more.

I work in HR and can assure you that if thru wanted to get rid of you and the notice period was a week no way would they give you any more. Even if you were starving in the street!

Why are you concerned about them? It's a business arrangement, if they wanted you to give more notice they would have specified this in the contract.

@Candle1000 don’t feel bad for them. If anything they’ve been taking advantage of you during your tenure. The boss is trying to emotionally manipulate you and unfortunately women are taught to put other people’s interests before their own. This isn’t your fault and you’re thankfully leaving a toxic work environment.

Don’t mention anymore of this to your new company. If you care about how people view you, then focus on them. They don’t need to hear all this drama. They just want to know you’re going to show up on Monday with a sound body and mind, that’s it. The old company brought this on themselves so don’t carry that awkwardness to the new place.

As she is giving notice she can state 1 week

The actual contract means fuck all to be honest, what are they going to do? Sue her for 1 weeks pay?

I think in the circumstances and given their conduct, one week is fine. When does your payday fall? Is there a chance they may not pay you for your last month if you are leaving 1st October? I am NOT a legal expert but I know we’ve had people just essentially walk out during probation period.

Sorry to jump in; my contract requests a very long notice period. Is that legal/enforceable? It’s been bothering me a lot and just seems there are a few knowledgable people on this thread.

Thank you @AmIThough - I did sign it but feel it’s not reasonable and wondered if it was enforceable. It’s not ambiguous/inconsistent either.

The contract states the employee has to give one week's notice during the probation period. There is no ambiguity.

In terms of the notice the company has to give to the employee during the period, it states one week on page 1 and two weeks on page 2. However, their cock-up doesn't matter as it is the employee giving notice so it is one week.

OP, stick to the one week per your contract terms, and leave on Friday. Don't worry either, you are doing nothing wrong.

Right , one week notice it is, thank you all for your support, my loyalty is now with the new company, I told them I only had to give one week notice and I will stick to it.

Yes, that's right.
It seems that they do not understand their own contract. Two weeks notice if THEY terminate the contract within the probationary period, One week if you do.
You owe them absolutely nothing.

I told them today that I will be leaving on Friday, they are furious with me, the atmosphere is awful, it’s sort of taken the shine off of getting a new job .
