AIBU to think this isn't "safe delivery"

So so upset right now Sad. Long time user but name changed.

I don't have much money and this mattress was going to be a real treat for me.

Mattress Man are refusing to help me - saying they have fulfilled their end of the contract having "safely delivered" the mattress. They have left my mattress on a front porch in the middle of a central London address on a main road - of course when I got back from work it wasn't there.

The company are refusing to even help - never had customer service so poor and unwilling to help.

Don't know what to do, just wanted to rant at having lost £250 Sad

Did you pay by credit card? If so get onto the company and see if you can reverse the charge due to their negligence

This is going to depend on whether you knew it was going to be delivered today or if they'd not given you a delivery date.

What happens next depends on what you agreed with the seller at of purchase/order.
Did you agree to a specific delivery date?
Did they actually deliver on that date?
Did you agree to a specific ‘safe delivery place’ or ‘alternative delivery place’?

Obviously that is not a ‘safe place’. If a real safe place cannot be found, they should redeliver another day. They fucked up, it’s not your fault at all and they should reimburse you. I would not let this drop.

Doesn't matter what day it was supposed to be delivered, it wasn't delivered to you, you didn't sign for it, so the sellers part of the contract has not been fulfilled. It is up to them to find out what's happened to it. Not you love! Don't take no for an answer.

If your goods were left in a place you didn’t agree to and they are now missing, contact the retailer and explain that you haven’t received the goods you ordered. The retailer may argue that their obligations ended when the goods were left.
But make the point that you didn't agree to the goods being left in this way and that by not delivering them to you, the retailer is in breach of contract.
If the retailer advises you check any neighbouring businesses or houses, ask for them to prove to you that the delivery was actually made.
If they try to send you a generic screenshot which doesn’t make clear where the package was delivered or who it was addressed to, you should argue that this isn’t proof at all.
If the retailer tries to argue that the delivery driver failed to follow the delivery instructions given, explain that the retailer can’t escape responsibility by subcontracting some of their obligations to a third party.
You contracted with the retailer for the delivery, not the delivery driver, therefore responsibility rests with the retailer.

You haven't actually answered though whether you knew it was coming. If you did then I wouldn't tweet them or anything because it was your responsibility to take delivery.

So was this a named day delivery or did they turn up out of the blue?

The delivery company took the liberty of taking a picture - it was literally left on an open doorstep in the middle of central London. This was at 2pm and by the time I got home it was gone (obviously it would be stolen having been left on a street in central London).

For everyone asking, I knew delivery would be today but I work full time. My neighbour kindly said she would take it in but missed it. By the time she came back from the shops : I came home from work there was nothing / no calling card. I only found out it had been "delivered" as I called them this morning.

The company is Mattress Man - their customer service has been beyond disappointing, essentially they have "fulfilled their duties". And I'm £250 down Sad

Reverse the charge on your card. Start there. Say what's true, you didn't receive it

Doorstep is not a safe place in my opinion. Is it a well known company? Might help to post on social media.

No they haven't legally fulfilled their duties. Unless you told them it was acceptable to leave it outside. which I assume you told them neighbour was taking it?

You will have to become a major pain in their butt.

You can still do chargeback on a debit card. Get in touch with your bank. We did when a nursery company folded taking our £600 pushchair order with them.
