AIBU to think this isn't "safe delivery"

So so upset right now Sad. Long time user but name changed.

I don't have much money and this mattress was going to be a real treat for me.

Mattress Man are refusing to help me - saying they have fulfilled their end of the contract having "safely delivered" the mattress. They have left my mattress on a front porch in the middle of a central London address on a main road - of course when I got back from work it wasn't there.

The company are refusing to even help - never had customer service so poor and unwilling to help.

Don't know what to do, just wanted to rant at having lost £250 Sad

Ok but the important thing is did you agree they could leave it if no answer? Regardless of whether the doorway was safe or not, if you agreed it could be left if no answer, then they are correct, they have fulfilled their obligation. If however you did not agree that, then under the Consumer Act you’re entitled to refund or redelivery. Their website makes it clear that you should check the items before signing for them to say they are acceptable so I can’t see how they can argue they leave things without gaining a signature.

Makes no difference if you paid via debit card the exact same rules apply.
I work in chargebacks and decide on cases all day long. I work for other side though so
Defend cases raised against our merchants.
In your case we wouldn’t even attempt to defend, you as the cardholder are entitled to your money back you have not received the goods. No signature is viewed as non delivery as far as Visa and MasterCard is concerned, and it’s their rules which supercede any companys terms and conditions when transaction processed through either scheme.
