AIBU to ask if you would claim compensation after a minor accident?

I was involved in a minor accident on Friday I was hit head on by another car at low speed. I have my hand on the horn the crash forced my shoulder to slightly move out of the socket but to not fully dislocate, AC separation. The other driver left the accident so I rang the police it was all caught on cctv so there is evidence. Dh thinks we should claim I'm not so sure so wanted opinions of what you would do.

Unless I was injured in a way that caused me to lose money (being off work sick etc) I'd not claim. Is the other driver even insured? Flowers

Sorry to hear you've had a crash, it's really scary, even at low speed.

Have they located the other driver? Who's insurance is covering the car repairs? Are you off work with your injuries?

The damage to your car could be more extensive than it looks. You might need to go through your insurance who might go to the other parties insurance.

For physical injury not unless it was serious and impacted by life

How minor.? What was the damage to the car? Do you still have pain in your shoulder? Only asking as I would be concerned about the repair bill. Also, did the driver get out of the car and look for possible damage or did he drive straight off? Hope you are feeling better and getting over the shock.

I have informed my insurance company and the other driver is insured. I think the other driver may have been drinking and that is why they left without stopping, I think this because they mounted the curb on the road they were on drove over the pavement and cut the corner then drove into me. I was stopped at this point to try and avoid a crash. I may need an operation on my shoulder and have started physio yesterday.

My arm is immobilized apart from at physio, it is a type of sling but then it wraps around me waist to hold my arm in place against my body, I have to sleep in it as well. I will be in the sling/wrap for 6-8 weeks.

That's not a minor injury. Claim.

Some arse claimed whiplash when they clipped my DH's motorbike. He was off work for 2 weeks with his injuries but made no claim. The wanker car driver claimed & 2k for whiplash despite not seeing any doctor, nurse, medical professional of any sort and taking no time off work. It was a 50/50 fault accident in the end.

DS was involved in a very minor incident recently. A car reversed into him while he was standing behind his own car, crushing his leg for a couple of seconds. No serious damage but painful for a few weeks.

The driver was terribly upset and immediately admitted liability, informing her insurers. They contacted DS with an offer of compensation within 48 hours giving him 24 hours to accept. It was a risk as if he’d been laid up for months he would have wanted more but actually he was already walking/ limping around and had had medical reassurance so he accepted it.

So, I see it that insurance companies just want these minor issues off their hands- he didn’t even make a claim.

So, yes. And don’t use a no win no fee lawyer.

Yes you absolutely should Shock

Dh had someone crash into the back of him last year and he needed 8 physio appointments for his neck/shoulder. They paid for all his physio/painkillers (was about £600)

Even now he gets twinges if his neck gets cold (and he's a really fit runner)

Surgery and 6-8 weeks in a sling is not minor. I think you need to pursue this.

Sorry, just read your update. Not minor at all. Consult a reputable personal injury lawyer. You don’t have to use the legal firm your insurers might prefer ( cheaper).

It may take ages, though as the long term impact will have to be assessed.

I thought my whiplash injury from 17 months ago was well and truly healed. But I went to the cinema on Monday and my neck has hurt on and off since then. Just what I need at 33 weeks pregnant when I can barely sleep anyway FFS.

That you are strapped, seeing a physio and have been told you may need an operation tells you that your injury isn't 'minor' and should be claimed for. You have suffered injury and will continue to suffer loss.

Claim.

Might need an operation definitely means this was not a minor accident. You should claim. You don’t know now what complications you might have in the medium term. Make a note of time/expense as a consequence of this collision.

It looks like people are with dh then, I called it minor as there is no life changing injuries. I just feel a bit guilty claiming but it was 100% their fault and 100% been avoided.

That’s not minor and could need a long term course of treatment. I wouldn’t rule out claiming until you know the extent of injuries

You say it’s not life changing but I have shoulders which dislocated all the time until I had operations on both. It’s always had quite an impact on my life.

Figaro88 I felt guilty too for a while but why the fuck should we? In my case, we were minding our own business on the M18 and someone smashed into the side of my car, pushing us across the carriageway. My four DC were in the car too. I still have horrendous anxiety if there's a car "next to me" at speed i.e. on a dual carriageway or whatever. Especially if it's silver like the one that hit us.

It’s not a minor injury; your life is being significantly impacted on and I’m imagining some ongoing treatment so I would definitely claim

If it has been a minor prang and the other driver has stopped and apologised and no real harm was done I’d leave it.
In this instance the driver didn’t even bother to check you were ok and hasn’t even acknowledged making the error so you need to pursue to make then think twice about being so negligent again.
