I have an upcoming PIP tribunal and I’m so nervous Sad

I had my whole award removed after a face to face assessment (report was completely inadequate but was used in favour of actual medical evidence from an actual specialist Hmm)

The PIP regulations state that a person should be able to complete a descriptor safely , in a timely manner and reliably .

In my medical evidence it specifically states that I might be able to complete an activity in the am , but not in the pm due to worsening fatigue.

In spite of arguing this point all throughout , I’m going to tribunal .

Based on this regulation - do I have a chance ?

I’m so nervous I don’t want to go if there’s no chance of winning for fear of looking like a liar or fraud Blush (I’m not! I’ve been honest throughout).

Thoughts ?

I wrote up thread (under a different name) that I had my MR coming up- I lost it. Zero points on daily living and standard mobility. I’ve just given up now 🤷🏻‍♀️

Most MRs fail Snowy, it's part of their concerted effort to make you give up. Please keep going to the tribunal if you can, don't let them win!

Absolutely, don't give up now, Tribunal panels are independent, they actually read all of your evidence and they listen to you. You have over 70% chance of being successful at Tribunal.

Thank you, BlankTimes and darkriver. I've been getting used to the idea I might still have a life to lead...

SnowyAlpsandPeaks, please don't give up because of the MR. That's done by the DWP, the same people who lie and who falsely claim you don't meet the descriptors in the first place.

The MR is an irritating step to go through, because it's almost meaningless: the liars and wrongdoers of the DWP aren't going to suddenly do a fairer job for the MR than for the original decision.

The tribunal is unrelated to the DWP. It's by a different organisation: HM Courts & Tribunals Service.

If you feel you can't face any more work to take it to the tribunal, then of course that's your decision. But the MR is just intended to be a fence in a steeplechase – intended to make you give up before you can get to the people who might actually give you a real hearing.
