Lost my job 2 days after starting?

Honestly don’t know what to feel but just
Need to get this off my chest...
I started a new job as a HR manager at an organization which literally begged me to
Choose them over another 2 job offers. It was all good the first two days and then I get a phone call the next day saying there was a restructure in the office and my job is no longer needed...I left my employment and rejected the other two offers for this role and they piss me off after the second day? I am livid and need to know if I am AIBU to demand answers and request a replacement job? Give me your opinions ladies...

Unfortunately, if you had only been there two days, I don't think you have any kind of legal redress - unless you think they got rid of you because you have a protected characteristic, such as a disability.

Could you contact the places you rejected and see if they still have an opening - worth a try?

Misrepresentation to induce you to enter into a contract with them. Damages at least loss of wages you were already earning or would earn at the other jobs. So a common law remedy rather than employment rights issue.

Could you possibly see if other jobs still available? Possibly not as I assume there was a notice period you worked?

Thank you for your reply, unfortunately not as they have already filled those roles! I know that’s what is annoying. The only thing I think might of came into play is maybe discrimination as I wear the scarf? I have this feeling that someone at that organization was not happy about me as a new hire and decided to get rid of me without making it look discriminatory

If you were the HR manager surely you have a bit of clout behind you in your role and therefore can definitely push for reasonings? On a side note, how does a company restructure to not need an HR Manager?

That is exactly right and the saddest part is the organization didn’t tell me, they got the recruitment agency who initially put through my resume to tell me even though I signed a contract as a permanent employeeShock I am at a loss and no one will answer my questions as they are apparently bounded by confidentiality

This all sounds very strange. Restructures take longer to organise than this and surely as HR manager you'd be aware of it?

Did you wear the scarf to the interview? I think I'd be giving ACAS a call.

Perhaps speak to ACAS if you think your headscarf might have been a factor, because that would be discrimination if true. You'd normally expect an office restructure to be longer than two days in the making, so the excuse does sound flimsy.

I’m so sorry to hear about this, OP.

Could you contact ACAS and Citizens Advice? I think it might be worth seeing what they say about this.

It might also be worth contacting the other two companies where you were offered the other jobs and ask if they could keep your details on file so they can contact you in case they have any future job openings.

Yes I did but I had only the lady I was replacing in the interview, the senior leadership team didn’t see me till the first day; hence why I think it may be discrimination...I am baffled as well on why my job will need to go when I was the only Hr position there too, it was a stand alone role?

DP who has a law degree, says depending on the terms of the contract, you could sue them for breach of contract.

If they got the recruitment company to tell you that's even worse. He will protect them as his client.

I'm sure you know this as a HR manager, but employee have fuck all rights for the first two years - unless you can prove discrimination went on. If you believe it was because of your religious dress, you need to prove it somehow. I suggest pushing for a reason behind this restructure and get CAB involved, if it's all bollocks you may have a case to take them to a tribunal.

The restructure sounds like bs. There is no way that they would have done a whole restructure in the 2 days after you started. If they knew that they were going to restructure, then they wouldn't have employed someone for a post that is about to disappear.

I was confused too, Cheer, I thought the OP meant the 'MN scarf' and was injecting some humour into her post. I'm really sad that that's not the case, poor OP, what a thing to happen.

However, employment agreement was signed and that's a legal document. Take them down, OP, get some legal team behind you. It's disgraceful.

Thank you ladies. I will be calling the organization again tomorrow to ask more questions as I am not happy with their answers; they pretty much told me at the end of the day just before the weekend through the recruiter so I was left with so many unanswered questions and I tried speaking to them directly but they had pissed off to their Christmas party. As a HR manager I know there is nothing I can do legally as I did not complete probation but I still would like a more definite answer that actually makes sense! They said they will be paying me 1 weeks notice (as per the contract) but honestly as if that will make it for my loss of finances, job prospects and bloody dignity that I lost during this process...

it does sound very suspicious but unless you have concrete proof, such as something in an email or a text, or witnesses, then I think you may need to let this go and find alternative employment.

Really sorry to hear this OP. Does sound on the face of it discriminatory. As an HR Manager you know the drill - Insist on answers to your questions and make copious notes. Tribunals have such a backlog however that you need to crack on job hunting with hopefully a much better outcome. All the best
