Re wanting to claim about this accident?

I was involved in a minor accident today. Me, DH and 9 month old were in the car heading back home when another car crashed into us from behind. The car had a "New Driver" sticker on it.
Thankfully none involved were badly injured though I knocked my head pretty hard against the headrest and saw black spots for couple of seconds. Baby was fine, just seemed a bit shocked and flushed.
The other driver and myself were extremely distraught, she had her DD aged 5/6 maybe in the front seat belted.
We both were understandably very worried for our respective children.
An hour after the accident I went to the A&E as I was feeling extremely lightheaded and nauseous. I started having a horrible headache and my muscles were in "spasm" as described by the doctor who saw me. He prescribed Naproxen and told me the pain would eventually go away.
Now hours after the accident, the headache is the worst I ever experienced in my life. My shoulders and neck are absolutely killing me.
Should I be claiming whiplash and which agencies would you recommend please?
I am so sorry for the long post, my thoughts are all over the place and I feel so sickSad

Did the Dr diagnose you with whiplash?

busybarbara · 13/12/2018 21:02

the headache is the worst I ever experienced in my life

If you're not joking or exaggerating you need to get to a hospital immediately. This is a serious symptom.

wishingitwasfriday · 13/12/2018 21:03

Why do you need to claim? Has it inspired your ability to work, stopped you partaking in your normal activities? Stop thinking about money, claims for whiplash don't result in a large payout anymore as insurance companies are wise to people claiming just for the money.

Claw001 · 13/12/2018 21:03

I think symptoms need to persist for longer than a day to claim

Bringbackbertha · 13/12/2018 21:04

Did you get their insurance details ?

olivertwistwantsmore · 13/12/2018 21:04

So your headache is the worst ever, but your first thought is for compensation??

Hmm. If your headache is genuine, ring ooh.

Oysterbabe · 13/12/2018 21:04

Yes of course you can claim. Speak to your insurer and they'll probably recommend solicitors and have them contact you.

Peaspleaselouise · 13/12/2018 21:04

You should definitely get checked out medically.

However I think you’re unreasonable to be thinking about financially claiming already?? And if you genuinely are in that much pain, you’ll need to wait to see if/how your symptoms settle so that you vdont claim too early

Greenkit · 13/12/2018 21:04

Did the other driver give you her insurance details, I would claim off her insurance

Neverunderfed · 13/12/2018 21:05

I'd give it a bit more time tbh, to assess the level of actual damage.

Mumof1DS · 13/12/2018 21:07

Have you suffered any losses?

It won't be an easy pay out like people assume. Insurers are wising up and not just paying out. You will need medical evidence and evidence of your losses.

Redglitter · 13/12/2018 21:09

If you're in that much pain id have thought claims etc would be the least of your worries. Wait and see how long your pain lasts for a start. It could be lots better tomorrow.

XiCi · 13/12/2018 21:09

Someone crashed into the back of you and you have been injured so yes you can claim. Speak to your insurer.

European12345 · 13/12/2018 21:11

So your headache is the worse in a long time and first thing you do is to go to MN asking about compensation? I’d get it check again by a doctor rather than being on the net

olivertwistwantsmore · 13/12/2018 21:12

www.gov.uk/government/news/new-crackdown-on-whiplash-claims-set-to-cut-insurance-premiums

Here you are, op.

ZoeWashburne · 13/12/2018 21:14

Claim what exactly?

Oysterbabe · 13/12/2018 21:14

That hasn't been implemented yet olivertwist , you still get a reasonable payout for whiplash claims.

Ginormoustrawberry · 13/12/2018 21:16

Fuck me it’s not even 12 hours in and your thinking about a whiplash claim 🙄

pinkhorse · 13/12/2018 21:16

I would get off mumsnet if your headache is really that bad. Looking at a screen won't be helping.

Mossend · 13/12/2018 21:17

I'd be far more worried about having a headache worse than any you'd ever had than thinking about compensation

gamerchick · 13/12/2018 21:19

So your headache is the worst ever, but your first thought is for compensation??

And posting quote a detailed post on mumsnet. Hmm

WonderTweek · 13/12/2018 21:19

I'd probably ring 111 and ask about the headache. I'm not sure how a claim would fix it. Hope you feel better soon op.

BlaaBlaaBlaa · 13/12/2018 21:20

You will need to wait to see what damage has been done and the long term impact.
I was in an accident 9 months ago. I initially felt okay but 3 days later started with horrendous back pain. It still isn't sorted and doesn't look like it will be fixed anytime soon.

You will need to speak to they're insurance company as you'll need to replace your car seat as a minimum.

Shehz21 · 13/12/2018 21:21

Thank you everyone for your input.
I find it quite judgemental of some posters to comment about me getting off MN because of my headache.. People get on here everyday with worse health issues or worse issues in general,it doesn't mean they need to get off MN and deal with it right away.
I am on here to get some advise and would like to thank those who are doing so.

To answer some questions, Yes the driver did give her insurance details and knows she is in the wrong and admitted it several times already.

I have been diagnosed with whiplash yes.

Thank you Oysterbabe for clearing that.

I will wait and see if the symptoms persists before claiming. thank you again wise people of mumsnetSmile

I wouldn't worry, the companies will be ringing you soon enough...
My car was parked up when someone clipped my open door (was loading in baby and carseat) earlier in the year. Not long after claiming through my insurance, the phonecalls started, trying to get me to claim for injuries, and have been plaguing me since.
