Wheelie bin damaged neighbours car.

Hi,

I had my neighbours (both ladies from next door and one from opposite) knock on my door this morning to tell me that my empty wheelie bin had blown over and dented the side of their car.

They said that it had blown over once and they had picked it up, then it had blown over again into their car and caused the damage.

I was in my dressing gown and holding my crying (teething) baby so told them they'd have to come back later and speak to my partner when he is home from work.

Who is at fault here? I think neither as the wind is beyond my control!

I didn't hear the bin falling over, but they did, twice?

They supposedly moved it into the second position from which it fell causing the damage, so they have admitted that they put it in a place it was likely to cause damage if it fell.

If they had told me the first time I would have moved it.

Everyone on our street keeps their bins on the drive as there is no access to the back and nowhere else to keep them, so not just us.

I also feel as though the 3 of them knocking on my door together was to try and intimidate me into agreeing to pay any costs.

This happened between my partner leaving for work at 7.10am and 8.30am when they knocked on my door. They knew I was home alone with the baby (as I am every week day whilst on maternity leave).

Would I be unreasonable to say, no, we will not be paying anything? My partner wants to bring up the 3 of them banging on my door together to gang up on me when they know I'm home alone, do you think this would just cause further arguments?

I would tell them to consult their insurance, this is nobody's fault and this is why people have insurance to begin with. Dont let them talk you into paying for it because they don't want to claim, that's their problem not yours

In that case, no I wouldn’t offer a contribution. It wasn’t clear where the bin was from your OP.

they claim on their insurance, and the insurance can contact you if they want to. as they've got sod-all proof I doubt it'll come to anything. don't pay.

No, wouldn't give them a penny. That's one of the reasons why they (presumably) pay for car insurance.

The bin had been emptied by the bin men then left it there. It got blown over and the neighbours picked it up and left it there. It then got blown over again, damaging the car. So technically it’s not really your fault as you didn’t leave it there. I wouldn’t offer any money for repairs.

They don’t want to claim as it may affect future premiums but that’s not your problem. Don’t pay them anything OP.

Exactly how much damage do they say was caused? Hard to imagine an empty wheeliebin doing more than very superficial damage. (certainly not a dent). Or did the wind hurl it into their car? In which case, it is definitely a case of 'act of god' and a matter for their insurance.

I agree that 3 people coming round to ANYONE's house under these circumstances is a bit intimidating. Is there some sort of back story here?

Thanks all, I will tell them to claim on their insurance when they come back later.

@jaxhog no back story, neighbours who own the car are very friendly with most of the street, chat to them on doorstep of an evening for example.

I don't have that relationship with them but nothing bad. I smile and say hello if I see them.

Nope... no pay out.
They moved it and it then fell over from they position they moved it to and it damaged the car.
It did not fall over and damage the car from the position you had it in.
They obviously moved it too near the car and it would have been sensible in the high wind just to leave it lying on the ground.

If it was still windy they should have just left the bin lying down where it was. I appreciate they were probably trying to be kind in picking it up, but if they hadn’t picked it up, it couldn’t have caused any damage!

I’d suggest that they get in touch with their insurance company. If they think they have a claim they can contact your insurance company, but it doesn’t sound like you are at fault here.

Their insurance will cover it. Besides they could be bullshitting.

Id politely tell them you can't be certain that was what caused it and if they did move it the second time then it's really unfortunate they moved it where it would fall into their car, if that's what happened, bye now

My car door was dented by a wheelie-bin in high winds. I guess I'm just not so fussy, gave the bin a good ticking off, waved fist at God and got on with my life.
I don't understand why all three of them came round to inform you about this, nor why they felt to move it in the first place - as pp have said, it was much 'safer' on its side! Had they left it alone in the first place, or acted with some sense, none of this would've happened.

It's really irritating when things like this happen. A trolley bashed in to my car on a windy day at the supermarket - someone had obviously not left it carefully within the trolley park. I was pissed off - fortunately it didn't cause more than a scratch - but it's one of those things.

It's the same as if a tree branch fell on their car in the wind. Act of god. Not your fault. Tell them to claim. They are trying it on. If they don't want to go via their insurance they can cough up themselves.

Not convinced a wheelie bin has enough weight to dint a car unless it was hurled into the car by some gale-force winds. Either way, it's not your responsibility. Even if you were the last person to position the bin which you weren't, you don't even own the wheelie bin, it is the council's property. This is nothing to do with you. Direct them to the council.
