Bailiffs....I need advice asap please

Hello all I have and changed for this.

So I'm not far off murdering my dp. Many will say LTB but that's not going to fix my problem for tomorrow. I will deal with him later.

Dp has a debt to do with business however it is in his own personal name. Business rates. The company hasn't been doing very well recently and he has struggled with this and paid as and when he can. The bailiffs have been sent round to his place of work and left a letter saying they will be back to remove goods. Do called the number and said look I can't pay all. Can I pay a bit and set up a payment plan with you. Bailiff said I will give you until Friday (3 days ) to get what you can and if you are lucky we can agree something to let you pay it off by new year. Well we still won't be able to pay it off by then. As the council want the years business rates up front even though we are only a few months in arrears.

So they can't take anything from his work as he has proof the business owns everything not me. This so try as in finance in companies name and business rates in dps name. So the belief said I will come and you can show me your proof but then I will be coming to your house. He has our address. So I have some receipts for the tv and laptop to prove they are mine. But no receipts for anything else.

What can he take.... Can he take the tumble dryer, dishwasher?we have a spare fridge in the garage, sofas? My jewellery? Nothing worth much.

Thanks in advance. I know not aibu. But i am desperate and don't know what to do tomorrow. I'm more worried about the effect on my kids rather than stuff. Please don't bash me or dh. Times have been hard and the council didn't listen when we tried to sort it out before.

That's ok. I am is one of those keyboard warriors.i hope they never have any financial difficulty ever. And I hope they also work hard and have created jobs for others as we have done for some time and have now had one issue I know for a fact we are not the only one to have this issue with business rates.
We know a few other companies going through something similar.

It is a well known fact business rates are a killer. And they wander why the economy is failing

Everytime theres a thread like this, its always been ongoing for a long time... then OP reveals she's pregnant. And we're all supposed to say "oh honey, that awful, can't believe they want their money paid".

If the business isn't making enough profit, and you're going to get rid of it and use the money from the sale to pay off your debts then you won't exactly have much of an income left. The sensible thing is not to increase the financial burden on the household until all debts are taken care of. So now you're going to have to tighten your belts and live to a strict budget, whilst also paying for a newborn.

If you DP has not already then find out about local charities that offer debt advice for free. Citizens Advice or there are others. I volunteer for citizens advice but not specifically debt advice as we have paid debt specialists so I won't say anything here apart from not to open the door and if your husband has a car don't park it outside. There are other agencies also offering advice for free.

You will also need to check his credit files because if it is now defaulted or gone to court and is in his name his credit rating will be shot to bits for years.

It's using pregnancy as an excuse that the problem. Women have a hard enough time being taken seriously, especially in business. To be in debt, due to a business not earning it's keep, and then saying "but I'm pregnant, we don't need this stress".

So? What's being pregnant got to do with it? If you want advise on handling the debt then ask for that. But don't throw out being pregnant and expect more sympathy. Don't get pregnant if you or your partner are in debt. Can't do anything about kids you already have, but it's easier to take care of them on a budget if you don't add another child.

As for advice. Cur out all expense which aren't absolutely necessary. Cut down your grocery shop by switching to cheaper meals and cheaper options. Cut down on everything so you can offer them as large a monthly payment as you can, but keep a small buffer so you don't fall behind again. Like you should have been doing as soon as you defaulted. And don't add any more expenses to your life until it is paid.

Actually I only mentioned it because someone asked... I never asked for sympathy. I asked for advice and got It. Congratulations on your business. I'm glad you are doing well. I am sorry I didn't do a search on you...Hmm

As I said we will pay it off. And when we sell it the debt is paid and he will hopefully get a job in his sector as he has the experience. As I said we tried sorting it with the council and they just didn't accept. And yes I know we have defaulted that's why they want the year up front. But they never accepted the payment plans which were not too far off the original agreement anyway. Either way it will be sorted.

She willingly got pregnant while facing a huge debt which she fully knew about. And now want a sympathy because they're facing the consequences of the debt whilst pregnant?

Id be full of empathy if they hadn't CHOSEN to make their problem worse and then used it as a "we don't need this hassle" excuse.

The cost of a newborn is not going to inflict on us that much. I don't need to buy anything new as I have my things from the other children.... I have breastfed all so far so unlikely to be buying formula. And the youngest is nearly potty trained so won't be buying many more nappies. This will be paid off by the time the new baby will eb eating solids..Just wanted advice on what to do if they knock on the door.

Thread after thread of people who have been in debt for longer than 9 months, yet they are pregnant or have a newborn. It's just irresponsible. And then you want advice on how to keep the bailiffs away? They are only there because you havnt paid. You said you had an agreed payment plan, but fell behind and they wouldn't accept a new one? Well... that might be because they gave you a chance.

I don't understand people who know they have that hanging over them, but merrily carry on like it doesn't matter. Especially with a business; the priority should be sorting it out.

You work part time; your kids are getting older. You could have maybe found a way to work more to help pay it off. Newborn puts a stop to even trying to find a way to do that. Your partner would then owe you the money, but at least you wouldn't be sending bailiffs after him.

Just double checked all my posts. Nope never asked for sympathy. Someone said if you are pregnant or have children you are classed as vulnerable. So I mentioned I am as it is true. I never said I was vulnerable. I can hold my own. And I will sort out and push them into the payment plan that we originally asked for.

I have never stopped working. I work from home for myself and never taken maternity leave. Yes I could have gotten a full time job but my income would have not been that much different. You d9nt know what I do or what I earn...Hmm and no I'm not going to tell you as it is not relevant.

First advice as others have said, do not let them in. Do not let them persuade you to let them in and it is illegal for them to try to force their way in, although they are allowed to enter through an unlocked door or an open window. Do not open the door and make sure your doors are all locked!

Even if they have a signed court order you still do not have to let them in. The only bailiffs that are allowed to force entry are HMRC bailiffs, not ones appointed by the council. These people rely on fear and intimidation, they will tell you anything to get you to open the door. They cannot gain entry unless you let them in, court order or not. They may threaten to get the police to let them in, this is also a lie and they cannot do this, it's a tactic they use to intimidate people into letting them in.

Hope this helps, but do not open the door!
