Looking up medical records

My x wife works at a GP surgery and left me for a GP that works there.
She regularly looks at my medical records without permission at her surgery. And let's our x friends and tells our 2 children about the pills that I take for nerve pain and my medical history and warms them to stay away from me even tho they are both in their early 20s I have lost my relationship with my daughter as my x wife and her partner who is a doctor have both decided to dictate my life and I wouldn't fit in. I see my son regualy as he knows it's just them being controlling but my daughter will not see me.
I have been divorced 10 years and have not seen my x wife and her doctor partner since when I found out about the affair 10 years ago and would not be any part of their deceit and lies about me. Please help as he is a doctor with grand influence within the NHS I am stuck.

Complain, a lot. This is a massive breach of confidentiality and is a sackable offence. Doesn't matter if he's a gp or not.

Goes beyond complaint Thai is lose your job territory and employer getting fines. Look up GDPR and how to complain and work from there. If you are correct her log ins will be able to be traced. I don't even look up my own results because my employer (NHS) is so strict on the rules of looking up records.

Complain, I suspect they can check to see which records are being accessed by whom. It's a sackable offence and she'll know it!

It's very easy to get record accessing checked and whoevers looked at them without authorisation will get sacked.

There is the practice manager, or go to PAL who will take your complaint and investigate it for you.

Who do I complain to I have asked to see my surgery manager and told my doctor but I think they know him from the the 3 local hospitals and they are not concerned about it. They treat me as if it's in my head.
My x wife mentally abused me for years and all the time I was being accursed for anything and everything she wouldn't let me sleep in the same bed, all the time it was her and the GP. He is on the board of executives within our region and well respected. I just hit a brick wall I have written to PALS 3 times and never had a reply. I was left with nothing as I gave her the house and car as she kept telling me if I can sort myself out I could come back but she just played on my emotions to keep me sweet. Thankyou for your reply could I go to my MP about this ?

I ask my son and at least he is honest with me as I have always been with my children, she has even warned him about 1 of his friends who attends the surgery to keep his distance as he has depression.

It's irrelevant his position. Your ex accessing your records is the problem.

From what you have said, your wife would have known about your nerve pain , and meds already.
The surgery cannot ignore, they have to investigate.

You can complain to NHS England if you are not getting anywhere with your complaint.

If you are not a patient at the surgery, you have every right to complain and it should have a trial of access.

It's a criminal offence not just a sackable one. She can (and should) be personally prosecuted for this.

I am an Information Governance manager in local government and this is a very very serious accusation. Firstly, how do you know she still regularly access your data? Secondly, I'm from an NHS background so I can provide you assurances that everything undertaken on SystmOne is audit-able. Even if she exited the record without saving it, her Smartcard can be checked to see what records she has accessed over many many years. I could put her Smartcard in my machine, audit against her name and yours and it would bring up the date, time etc down to the second. If found to have accessed your records without reasonable cause, she will be dismissed. This is also reportable to the ICO, where she will end up in court, prosecuted, given a criminal record and a hefty fine.

So, your first port of call is the ICO. They will contact her practice and it'll set the ball rolling. They will keep you posted every step of the way and they cannot tell her who has reported her, or what they are looking for. All they can say is they are investigating inappropriate access to medical records.

One unauthorised access is a sackable and offence under GDPR. I would report her especially if she seems to do this regularly

I work in a GP surgery and I can't access the records of patients in a surgery 2 blocks down the road. If a GP surgery has a satellite surgery they won't be 15 miles away from each other. Your belief that she accesses your medical records is a bit far fetched.

Can you answer how you know she is doing this?
If she has been then it's easily provable. See the practice manager and ask to escalate.

@TroysMammy I did wonder as I thought one of the problems with the nhs was that it wasn't all on one system.

@TroysMammy you are absolutely right, I had forgotten about that bit (I used to work in a trust so all systems were on the Spine). It's highly unlikely to be a branch surgery that far away, although not impossible. The records she is reading must therefore only be historic.

What evidence do you have that she is looking at your medical records and discussing this with other people. If she is and you have proof then report it as others have said.

It sounds as if OP's ex wife has been telling people his medical information - I advise you report it and it will be investigated. As others have said its easily trackable and you should get a response in relation to your complaint that will explain the findings. The OP does not need to find further evidence but equally she wont get sacked/prosecuted etc without an investigation substantiating this.
