...... to sort out their tree!?

Over the weekend, the High winds caused a branch to literally crack and hang down - the tree is in the graveyard, situated behind our house. Our house is lower than the graveyard and the tree hangs over us:

The branch that is hanging is around 20ft long, the branch width is around 3ft - so it's a big blighter!

I don't want it to take out the fence when it eventually drops.

The vicar says it's not the churches responsibility (?) and that hallowed ground belongs to the local council... but the council say they don't own this bit of land.

Aibu to think, the vicar is trying to get out of paying for a tree surgeon?

I have no idea but also wanted to compliment you on your wonderful diagram!

I think legally it is probably not the vicar’s personal responsibility but it is probably up to him to sort it out if the land belongs to the church. More likely to be the council’s job though. If all else fails, the Land Registry might be able to tell you who owns the land.

It is the responsibility of the Church. Get in touch with the Diocese who are in control of your area and complain. Then complain to the Council or your MP and whoever will listen. I love the diagram too!!! We are next to a Church graveyard so if this happened to us, I would not be happy.

Great diagrams OP.

Assuming that the little men arrived on Monday lunchtime before you had had chance to make further phone calls and go "over the vicar's head" , could that mean, perhaps that God might be a MNetter and reads the odd thread in a quiet moment? So maybe he arranged for a bit of help.

I believe it depends on whether its a closed or open graveyard ie if burials are still been done or not, if they are still open as a burial ground it falls on the church and thier PCC Perochial Church Council, if its no longer actually ve and is technically a closed graveyard and all burials have stopped then maintenance falls on local authority. Either way the local authority should know as to speak to thier health and safety department they will investigate whether its theirs or not and will contact the right people to ensure its made safe.
