We have just completed on our house yesterday we finally got the keys from our seller at around 4pm The whole place has been left dirty marks on walls etc which I can cope with however I’ve gone out to the garden and she’s taken all the flowers from the borders and believe it or not the 8ft x 8ft deck I’m Shock the garden looks so ugly and I’m left with lots of rubble outside my patio doors. I called my solicitor and he was busy but will look into it first thing Monday. I just don’t know what to say, who takes their decking????? I’m so upset and angry right now..

What did it say on the fixtures and fittings form? Though I would argue decking is a fixture...

Completionmisery · 21/07/2018 10:07

It said she would take some flowers though I didn’t think all and they have said the decking was floating and not actually attached

Get some photos today, with the date on.

ScreamingValenta · 21/07/2018 10:12

You're better off in the long run without decking. Having decking in your garden is like providing a hostel for mice and rats.

However, as pps have said, you need to check with your solicitor whether it should have been left.

sunshinesupermum · 21/07/2018 10:13

I would have thought decking was a fixture like kitchen cupboards. They should state on the form exactly which flowers they are taking. I remember we had to.

Completionmisery · 21/07/2018 10:14

My husband took some last night, I can’t even let the kids out now either hopefully the solicitor will sort it out. Don’t even know how that would work would they have to rebuild it? I’m still Shock

I agree with the decking being a pain. I've repainted mind twice in 5 years at the cosy of £45 per coat. God knows what's underneath it.

It seems a bit weird the people taking it, but in the long run, just get a patio put down. It'll look nicer and last year's without much maintenance. It's all a bit of a shock when you move in, but you'll soon get it all looking lovely 😁

agedknees · 21/07/2018 10:20

Yanbu. But she’s done you a favour. As a pp said, decking is like the ritz for rats.

fiorentina · 21/07/2018 10:25

It is really annoying but you can replant and sort out a patio. Concentrate on making it feel like home and it won’t seem so bad. It never ceases to amaze me how ridiculous some sellers can be but don’t let it taint your new home.

SandyFagina · 21/07/2018 10:26

Decking is shit so you're much better off without it.

causeimunderyourspell · 21/07/2018 10:28

God I can't believe how petty some people are!! At least you won't have slippy horrible decking with who knows what underneath it. I can imagine how upset you must be though Thanks hopefully it won't fit in their new place and then they have the arduous task of chopping it all up and getting rid!

Completionmisery · 21/07/2018 10:31

We’re off to the local garden centre I’ve told the kids they can pick some plants so it will be a new start and maybe they can pick a different one each year or so, thanks for your replies Smile

Garden plants in the ground are considered as fixtures as well. Taking ones in pots is fair enough though.

Aridane · 21/07/2018 10:38

How horrible not to be able to enjoy your garden on moving in

MereDintofPandiculation · 21/07/2018 10:47

Garden plants in the ground are considered as fixtures as well. But you can take specified ones provided it's stated at exchange of contracts. I was able to bring with me a couple of trees that had sentimental value, and I was happy to let our seller return and take selected plants that were in the garden when we moved in. What you shouldn't be getting is a surprise.

Mummyoflittledragon · 21/07/2018 10:52

They aren’t allowed to leave the rubble. Any damage must be made good. You’ll have to check on your fixtures and fittings document about the decking. If the property was marketed as having decking it should be there unless flagged on the document in which case it should have been addressed before exchange. Very cheeky and nasty.

rainforesttreeswinging · 21/07/2018 10:56

Try and turn it into a positive, this can be your summer project, and you can redesign the garden with your dc and make it fun. Colour theme the whole thing.

Spiteful behaviour, but don't let it spoil your new house

NotTheFordType · 21/07/2018 10:58

I had no idea decking attracted rodents. I now understand why at one rented house a few years ago my cat was bringing in far more mice than she ever had before!

Sorry you're having to deal with this shit OP, moving is stressful enough without this crap.

BMW6 · 21/07/2018 11:00

They have done you a favour by taking the decking, but they must make good so rubble etc cleared away at their expense. Get your solicitor on to it pronto.
What cunts.

Loonoon · 21/07/2018 11:15

Moving is stressful enough to make anyone cry without all that on top!

I agree with posters saying about the decking, it’s old fashioned, high maintenance and a rat magnet. Take the opportunity to have something better laid, happy in the knowledge your nasty vendor will probably have to contribute to the making good.

BlueJava · 21/07/2018 11:15

Be positive in the face of their CF-shittery. Choose some plants and do your own thing, but what they did was low.

headinhands · 21/07/2018 11:17

God I wish previous neighbours had taken the blasted decking

headinhands · 21/07/2018 11:17

Sorry. Previous owners.

SistersOfPercy · 21/07/2018 11:35

Biggest mistake I made decking our garden. The upkeep is a nightmare. So pleased the house we're moving into is decking free. Not a mistake I'd make twice.

It's only positive is it keeps our scottie dog happy for hours as there are field mice underneath it and he scrabbles around after them (he doesn't stand a chance of catching one 😂)

You're starting with a blank canvas, enjoy planning your new garden!

Completionmisery · 21/07/2018 12:21

We have picked some lovely flowers both girls got two each and I got two, were going to go back with my Mum and Dad and my sister and her DD’s on Monday and pick some more so it will be a lovely keepsake garden. We got a number for a guy to come and price up a new patio and I’ll speak to my solicitor further on Monday. Flowers to everyone feel bit better now
