Thought it would be clearer with this photo. Previous owner left note saying she used his dropped kerb. AIBU to use it?

The legal comeback was from previous owner not disclosing on going issue, particularly if the council have denied her a dropped kerb on the basis of the neighbours existing dropped kerb making it too long.

It has also been noted at sale that she can use the NDN dropped kerb so the lawyers who dealt with the sale should have investigated the issue more thoroughly as OP may well have paid extra as the House has been sold with off street parking.

There are some massive overreaction here. Mumsnet is vile at times. But no if they mind then you can't use it. I don't understand why people these days are so horrible though. I would let my NDN uses mine, doesnt cost me a thing. And it is always nice to be neighbourly.

Your not allowed to drive on the path, bump up kurbs, or put ramps in.

Get your drop kerb sorted that looks about £1500 It's expensive, you have no right to cut over your neighbours space or use something they paid for

Are you even sure that is a proper dropped kerb and not some home made bodge job? Why has it been done in concrete not tarmac?

Have you actually checked with the council it is a properly approved drop?

I'll say now what I said before it would be nice for him to let you use it. I'd let you if you were my neighbour but you have no right to insist upon it and if he doesn't want you to you need to stop. The previous owner had no right to offer you use of his dropped kerb and the fact that she/he suggested it is irrelevant.

YA (still) BU. Perhaps even more so with the photo. I was being generous in my head and imagined the kerb might be wider. I can’t see how you can get up that and onto your drive without crossing theirs.

You don't have a dropped kerb.
So you don't have a drive.
You can't drive over the neighbour's property to park on your garden. (It's not a drive. You have no dropped kerb.)
Pay up or park on the road you CF.

Fgs people. It is KERB in this context. Curb means to stop something. Please curb these spelling mistakes. I agree that OP needs to lower their own kerb.

If your house was sold with off road parking then you have a legal comeback against the vendor. Because you don’t have off road parking, you have a paved garden. Sue the previous owner and use the money to pay for a dropped kerb.

Have you actually spoken to the neighbour?

If I were your neighbour and I owned the wall between drives I would make sure it went to the path so you couldn't cut across to be honest.

Apply to the council (and pay!) to have your own dropped kerb which will also means cars shouldn't park block your drive.

Besides, a dropped kerb is not the only part of making it safe to drive over. They also strengthen the pavement that you’re crossing to avoid damage to pipes etc underneath as normal pavements aren’t made to take cars all the time.

So by using neighbours dropped kerb but crossing the pavement in front of your drive, you are risking damage to the pavement and any pipes underneath.

The council can also fine you for illegally crossing a pavement in this way.

Save up, get your own dropped kerb or park on the road.

Yeah your legal comeback is to pay a fortune to sue the previous owner and by the time you’d be done, it would be cheaper to sort our your own drive. You need expenses/losses to reclaim and you’ve not incurred any to date.

Considering op was quoted £1000 to get one done it DID cost ndn to have it put in. Why should op use ut free gratis? Op is causing wear and tear of the dropped kerb which neighbours will have to pay to maintain (and ops part if the pavement).

Why on earth did you start another thread op? The responses were clear in other one. And you agreed!!!
