To think a full refund should have been offered

I picked up cake today for DC birthday party - looked gorgeous but it stunk of smoke! The house smelled too but I thought maybe the cake would be okay - but when I checked at home it really smelt strongly.

I messaged the lady and said I thought the cake was wonderful looking but I wouldn't eat it or serve it because of the smell of stale smoke and asked for a refund also said happy to return the cake to her.

She has apologised and said no one smoked around the cake, she said she would refund my money minus the deposit.

Now, I am okay with this because actually I feel sorry for her, clearly she doesn't know how bad her house smells and then in turn the cake. But really I feel she should have offered a full refund.

Aibu to think this? Every time I look at the cake I feel sorry for her and then doubt my thought that she was being unreasonable to, one sell a cake like that and two that she should have offered a full refund.

I am out of pocket because I have lost the deposit and had to go to a supermarket and buy another cake.

Seller sells through FB page and has five stars!

You're putting it as if wanting your food free from smoke stink is somehow unreasonable!

Not, this is not even a question any of us should have to ask for goodness sake, it is a given!

When ordering a cake, things it is appropriate to check in advance:

Risk of nut contamination
Gluten free
Dairy free
Cost
Availability

Things no reasonable person would stipulate:

No bogies or other body parts in the cake
Dogs not to lick it
No smoke, Lynx or L’Oreal to be copiously spray and absorbed into the product

I didn't realise until after in the car. I was in a rush, it wasn't the baker I saw and I was a bit shocked. I was a bit suspect when I picked it up as the house stunk - but thought maybe the cake would be okay (baked elsewhere maybe) but when I smelt it in the car it was apparent we wouldn't be able to eat it. I am not going to give anyone, let alone my toddler a tobacco cake.

I didn't do all this just to make a fuss ! I wanted the cake !!!! I just wanted it not smelling of smoke!!

Freudian - I honestly don’t understand why you think someone should explicitly check that a food item shouldn’t smell of smoke.

I got a refund on made to measure curtains years ago because they reeked when I collected them. Should I have stated that in advance too?

It's not a given to the person OP wants a refund from.

Then that person should not be in the business of providing edibles to consumers!

I agree with you OP. My Aunties house smells very bad of smoke. She had a large open plan house and is the sole occupant who smokes. Even a carrier bag from her house stinks.

I agree you should not have to check the cake is make in a smoke free environment. You should get all money back and I feel you should leave a honest t view so other are aware. This is her problem not yours.

Im not particularly anti smoking to be honest. I do not smoke, 2 of my brothers smoke, my best friend smokes and my DP use to smoke. It's up to other people what they do, but no one should be selling cakes that smell and probably taste of smoke.
