Yesterday I got stuck in awful traffic. This doesn't happen often as I usually start work early, but had to wait for kitchen fitters so started an hour later.

Got to work about 20 mins late and boss had a bit of a go that I didn't let her know via text. I explained I was in bumper to bumper traffic and couldn't use my phone (I've only just got rid of six points on my license and don't want to risk getting more)

She replied that "it's a quick text, you're not going to get caught sending a quick text"

I still refuse to do it, regardless of how quick it may be.

Who is being unreasonable, me or her?

What a horrible working environment! Apart from asking you to do something illegal they are treating you like a child. You were stuck in traffic, it happens. It's not like you were lying in bed!

If you are stopped using your phone you will probably get away with a £200 fixed penalty notice and six points. But it you say I was only sending a text you will probably end up in court - still six points but a higher fine, costs and victim surcharge. And rightly so.

Basecamp, you do understand that you are still breaking the law, right?

I hope one day that texting and phoning while driving is regarded socially the same way drink-driving is now regarded.

@artisancraftbeer

I don't touch my phone when I'm driving. I do however spend a lot of time driving alone. If I ever have an accident, I want my phone in the car with me where I have a chance of reaching it, not locked in the boot totally out of reach.

I think you should definitely not have text while driving. However (and this might not have been possible) you should let someone know that you are running later as early as possible. I have my phone connected to my car so can use controls on the steering wheels to call work if I'm running late

I think my response would be -- are you prepared to take the points and pay the fine if I am caught? I know what the answer to that would be
