To be furious that I've been sent a £100 parking fine from KFC?

We very rarely eat there but one Saturday afternoon the children and i were hungry and I've always had a weird love for their chicken burgers. Went in. Ordered food, ate food, went to loo, had ice cream went to loo again (two DC both seem to need loo moment food arrives). Went home.

Now get £100 fine as it took us 62 minutes to eat. Now i know these are to discourage people from parking and then going off and doing their shopping but we truly didn't!!!

This seems to be happening a lot now! There were a few other cases on the news as well.

TittyGolightly · 16/09/2017 14:40

There's a nurse at a local hospital that went to court and lost and has to pay £60k!

WonderWhippet · 16/09/2017 15:12

I would say pay it, you stayed over the allowed time.

Ignore anyone that says to simply ignore the letters, as a pp said the legislation has changed and the Company will take you to court and probably win.

There is plenty of good advice on on-line forums. Just make sure you have all of the facts/knowledge to hand before making a decision regarding what to do.

MrsJamesAspey · 16/09/2017 18:43

If you go to your bank and ask for s print out if the statement it should show the actual transaction date as well as the date the money came out.

Then dispute it with KFC,

MongerTruffle · 16/09/2017 18:46

Legally do they not need to have a 10 min window after the time before ticketing?
That only applies to council-operated parking. Private companies can charge you as much as they want for breach of contract as long as it was clearly displayed on entry (they cannot fine you).

Hugs4Everyone · 16/09/2017 19:04

Depending on the location I don't think it's unreasonable for companies like KFC to have an hour maximum limit on their parking. If they are situated in an area with limited parking then it makes sense. obviously it has to have very clear signs.

Having said that I agree with everyone else who suggested that you contact KFC and ask for the charge to be waived.

I turned left on a bus/taxi lane yesterday so am awaiting my own fine to arrive. 😭😭😭. I'm usually so careful, I've been driving for 35 years and have only had a single parking fine before. I think it's only £30 though so not too bad. £100 is ridiculous.

Would that matter, though?

I would imagine they aren't going to claim OP didn't visit KFC.

Sallystyle · 17/09/2017 15:20

I got a ticket for something stupid.

I have been ignoring it for months now. I was going to appeal but I never quite got around to it. If I get a proper official letter ill pay it.

I am a member of that FB page and they tell everyone to ignore the letters from DRP that I keep getting.

MrsJamesAspey · 18/09/2017 09:19

But that's why they have these car parking companies, because people use the car parks and go somewhere else. They're not worried that people are loitering too long in KFC, so yeah proving that you were actually eating there and saying that you won't go back if the fine stays is a great place to start imho

flownthecoopkiwi · 18/09/2017 09:24

we had parked somewhere else and done some shopping and then moved the car to the KFC car park and only eaten there, nothing else. I may have been a little longer in the car park because I was trying to call my DH and return his missed calls. We've had a huge family emergency and was worried something had happened...

It's just another thing on the To Do pile now. DH says pay and then promise to never ever go back to KFC OR challenge.

Don't pay until you have at least had a go at appealing it.

I went into a petrol station to use the air machine. Unfortunately I managed to deflate my tyres so called the AA to remove inflate them.
I got a parking ticket, £120 fine I appealed stating why I was in the petrol station for more than 20minutes and had it written off.

As well as the receipt you could always ask them to review their cctv footage to show you were eating and in their restaurant .

Fruu · 18/09/2017 10:52

forums.pepipoo.com/index.php?showforum=60 have great advice about how to appeal private fines. I've successfully had a few cancelled after appealing using suggested arguments from that forum and some of the members helped me to edit my letters. :)

Maskoff · 18/09/2017 10:59

Lol ignore

TDHManchester · 18/09/2017 11:12

Get yourself over to pepipoo, join the forum, read and seek advice BEFORE you interact with these criminals..

jenniferl1983 · 18/09/2017 11:20

Definitely appeal to KFC and whoever owns the car park. They do not want to lose genuine customers.

If that fails (unlikely but just in case) you have a case based on grace periods. It takes time to read the parking signs and to leave so you could easily argue 2 minutes was not enough to do so.

DO NOT PAY! you have a good case. MSE parking forum is great and will help you.

wasonthelist · 18/09/2017 11:28

Plus you don't have to pay it anyway.

This used to be true but is not any longer.

19lottie82 · 18/09/2017 11:30

You didn't get a fine from KFC, you got a CHARGE from the private company who manages the car park.

Go back to the KFC and speak to the manager, they should be able to get the charge cancelled.

ShellyBoobs · 18/09/2017 11:51

Maskoff

Why should she 'lol ignore' it (whatever lol ignore actually means)?

That's the best way to end up with a CCJ.

It needs to be dealt with, one way or another.

PrincessWatermelon · 18/09/2017 13:44

I successfully appealed one from Lidl this weekend. You have 2 hours to park, but have to scan your receipt barcode and enter your reg plate in the store. My husband thinks he entered my reg plate wrong, so it didn't have a record of us.

I figured I might as well appeal as it holds the timer on the charge until the appeal is dealt with. I wrote a really nice email and explained he'd put the wrong reg in (even gave examples of what he might have put in!) and said we often go there. Was amazed that they waived the charge.

So no harm in trying!

TheVoiceOfTreason · 18/09/2017 15:21

Was it KFC themselves who sent you it or one of the ParkingEye style private parking companies? It may not be up to KFC to administer it.

I know Parking Eye had a test case at the Supreme Court last year regarding the enforceability or otherwise of these sorts of charges - might be worth trying to find out what the outcome of that was as I m afraid I don't know!! It might be very relevant though to whether you legally have to pay or not.

Over an hour though to eat your meal at KFC?! Really? How the heck did you manage that? (Not just judging. Just baffled as to how anyone can take over an hour to eat a fast food meal! Mine are gone within minutes, but then I'm a greedy pig tbf...Wink)

OlennasWimple · 18/09/2017 15:24

Twitter complaint about being two minutes over the limit

flownthecoopkiwi · 18/09/2017 15:28

i had two children with me. One is 3, the other is a girl who can't eat at any speed without taking constantly. They both, combined and separately, had to go to the toilet. Twice. We chatted, we laughed, we had ice cream.

I had no idea there was a time limit. I spent £15 on food and then £3 on ice cream, which at the time I thought was a bit of a bargain for their little sundaes. Ha!

If it was on a retail park, complain to the management company. Landlords will generally rescind tickets as a goodwill gesture as returning customers are more important than the income from fines.

RhodaBorrocks · 18/09/2017 16:07

This post reminded me to put in a complaint about the service I received in my local KFC on Friday. So thanks OP!

Misses point of thtead

TDHManchester · 19/09/2017 17:59

The only real way of sorting this is to deal with it in the correct manner.

i.e submit your correctly worded appeal, have it rejected, obtain a POPLA code and submit correctly worded docs to POPLA. Any delaying and you could end up with a large claim in the county court and a CCJ.
