Bloody eBay aibu to tell this woman to do one?

Sold a very expensive designer item of clothing, think £300-£400 on eBay for £36. Buyer is no claiming its way too big and she wants a refund, even though the size is correct and I stated in my description that it's really big and could easily fit a size bigger. It's not my fault if it's too big for her. Arghhhhh

You have to refund her under distance seller regulations. Get her to return it and refund her . Get your facts right next time. It is consumer rights.

No you don't. The law says as a private distance seller, rather than a business, you only have to refund if what you sell relates to your trade. I looked into this big time when someone insisted that I had to accept a return when the rules changed in 2014.

My trade is financial accountancy so if I sell a dress it has bugger all to do with my trade, therefore no refunds required.

Has the buyer opened an official return request? If so......

If the reason for the return is "it doesn't fit" or "didn't like it" then you can decline the return.

If it's "the item didn't match the descriptions / photos" or "there's something wrong with it" then unfortunately you must accept the return (and pay for a return label) otherwise eBay will force the return anyway and take your money.

I refused to refund someone who bought something from me and said the size was wrong even though I listed it clearly as the size on the label. They opened a case through PayPal but the couldn't decide who was in the wrong so I kept her money and they refunded her, which I thought was a bit unusual!

I always thought this and ebay refunded the buyer. She claimed the dress had shrunk. They can get round it by stating that the item was not as described and hell if it is they can damage it to make sure its not.

I had this too but this is ebay that a claim is raised. Ebay WILL refund the buyer.

Yes, but ebay has it's own view on that, and are impossible to argue with.

For goodness sake this is so ridiculous. Ebay definitely likes to make things difficult for sellers doesn't it

Its so unfair. I felt seriously pissed off when i lost the case. The good thing though, i went on and sold it for much more!!!

As long as you play by their rules it's a brilliant place to sell.

And I don't disagree with most of their policies.
Buyers need to have confidence when buying stuff on ebay. It keeps the community safe.

Actually, if you emailed through eBay the measurements and have stated the size plus the fact that it's big fitting, then she doesn't have a case.

chances are though, ebay will force you to refund unless you are the lucky 1% who manage to have the case fall on their side. You can try to refuse but be aware that chances are it will not go in your favour and you could end up getting a defect on your account.

Stand your ground. If you say no returns and she had all the information then it's tough. I've bought stuff that doesn't fit and I've just sucked it up.

In the end i reported my buyer on receipt of the dress. There was nothing wrong with it. It had not shrunk. I was annoyed.

This is why I no longer sell on Ebay. The chancers have ruined it for everyone else.

It certainly looks like she is trying it on and is a bit of a chancer, especially when you contacted her with the measurements. That is what puts people off selling on e bay tbh. I would accept the refund, but she will have to pay for postage herself, and you will have to have the item in your hands before you refund. Check the condition of the item, and if it is not in the condition you sold it, give her a partial refund.

We may not agree with their rules, they may seem unfair but that's how it is. If you don't like it you don't have to play.

There is plenty money to be made for those of us who suck it up and play the game.

But that's what's so frustrating cailleach. I have played by their rules. It was listed and described correctly. The buyer is not being a decent person. Why is their so much buyer protection but not seller protection? It doesn't make sense. I understand wanting to protect the buyers so they keep buying things, but if sellers aren't protected they will stop selling and the buyers won't be able to buy. It's very bizarre

i do understand your frustration, but you won't gain anything by standing your ground- you will lose this.

At least if you accept return you will get the item back and hopefully no feedback.

If you refuse to return ebay will refund the buyer ( even if it hasn't been returned) you will get an account violation and probably bad feedback.

It sucks but that's how it is.
