To think she tricked me?

So I recently got a seasonal job working on a holiday park, living onsite. A couple of weeks into starting, my manager asks me and a few other staff if we'd like to go down to the pub one evening (6 of us).

At the pub, my manager appears to get quite tipsy and keeps on buying rounds for everyone, refusing to let anyone spend their money. Everyone is enjoying their evening, laughing and joking and talking. Another member of staff is not drinking at all due to being on antibiotics.

Just before we leave, I go to the toilet, and when I come back she says 'the taxi's not coming for 20 minutes, I've got you another glass of red on the table Jane, one for the road!" I told her "Thanks, ready for bed now, struggling to keep up with you!" It was pretty late by the time we got back on site, and the manager asks who would care for a nightcap in the staff room before we headed to bed. I said thanks for the offer but no thanks, my head was spinning and I was ready to sleep.

The next day we aren't working, but all had to go to a training session at 10am. My manager informs everyone that they need to come to a meeting in the staff room at 8:30. When I get there, she announces that she is doing random breathalyzer tests on two people. She picks the lady who was out with us all and not drinking (and she KNEW this) and me! I failed the breathalyzer (by a tiny percentage) and she says 'Sorry Jane, I'm going to have to give you a warning, staff can't turn up for work with alcohol in their system. Luckily it's just training today otherwise you could have lost your job."

AIBU to think cheeky bitch, you were the one that invited me out, bought me a crap ton of wine and then tried to make me carry on the party after we got back! I feel like I've been set up somehow, because I'm the newbie, especially as the only other person she breathalyzed was someone she knew hadn't touched a drop.

Sounds like a trick to me.

That said I wouldn't want to be turning up for a training day drunk so either wouldn't have gone or just had a couple.

It was a trick / power trip thing

And that's what this is. So you know who she is now. Do your job, but don't bother going the extra mile for her, and refuse all further social invitations.

I'm inclined to say. Just sit back and wait. This abuse, and. It is abuse will come back to bite her on the arse.
Her staff will just wise up and find jobs somewhere else. You can run a company/ business with out your staff.

I don't them but I know of someone. Who owned a hair salon. Anyway she treated her staff so badly. That one by one. They just left. Leaving her with no staff to run her business. Needless to say. The shop closed down.
I'm afraid I have no sympathy. Good old pay back.

Does she even have the authority to go around breathalyzing employees?
I would be looking into that aspect of it. You may find it comes under bullying and harassment.
I know some jobs that involve safety, eg transport industry and any profession involving driving perform random drugs tests on the staff and rightly so.
But does this woman have the authority? Legally?
I would be looking into that.

We would call this... had your Test been positive... Constructive Dismissal... She absolutely manipulated the Screenings... and therefore you would have grounds to pursue a legitimate claim...

She's clearly a nasty bitch. I can't suggest anything other than find a new job. The only good thing here is that you now know that she's sly and you can't trust her and you can deal with her accordingly.

Do not trust a single word this woman says about anything. Double check your contract and employee handbook. Join a union. Keep a diary of everything and double check every directive via email so you have a paper trial. If what you have been asked to do is not in your contract/handbook query it with management or HR. For whatever reason, you are in her sights.

Go over her head. If you deserve a warning for turning up to work with alcohol in your system then so does she. And it's highly unprofessional for her to be encouraging junior staff to get hammered before an early start. She didn't make you drink to excess but she should have been discouraging it/reporting people she felt would not be fit to work not trying to get you to drink more!
I would assume she wants you out of the job for whatever reason and to be honest I wouldn't want to work under her unless I had no choice.
If it was some sort of 'test' then I doubt her bosses would be impressed. There must be a 'no alcohol' rule for a reason - I'm assuming you have to take care of young children as part of your job?

The legal advice around testing employees is quite specific - a qualified professional to test, in your contract etc. I would be inclined to read up on it and keep detailed notes of this (and any other instances of similar behaviour!)

She didn't do random tests. She picked you and the other employee.

Refuse to accept warning on this basis.

That's weird behaviour but make sure everyone knows never to socialise with that manager under any circumstances.
I hope she finds it a very lonely time at work from now on.

All the way? Then ask for a copy of the warning and give ACAS a call. Proceed as they suggest.

Maybe she wants you in a vulnerable position so she can ask you to cover shifts etc with the"well, you've already had a warning" to keep you in line?

I agree that this is shitty behaviour HOWEVER since you've only been there a few weeks you could easily have been sacked anyway... So yes watch your back but also don't forget that you are on a thin line anyway given your service. All the comments re breathalyser policy: yes it is not wrong to say there should be a clear policy etc etc however and again most importantly the OP can be sacked any day anyway unless she can show she was targeted due to some protected characteristic (race, religion etc) or similar issues.
