TRying to sell the house with tenants in - undisclosed dog

So had a viewing at the house yesterday and the patio was covered in dog shit, as was the garden. I figured it would take a few months to sell so was happy for them to stay whilst it was on the market. Am now starting to think this is going to be impossible isn't it ?
Can I afl them to remove the dog for the rest of the tenancy ?

It is your fault then take it on the chin. You did not put a no pet clause in and now you have to deal with that. Like I said ask them to clean up but that is all you can do. As much as I understand you have your reasons to be selling they are losing their home have some fucking sympathy

I bought my house when there were renters in it. Sorry i have not read the whole thread but the people in my house at the time went out of their way to make it revolting. Empy beer bottles everywjere plates on the floor, turd in the loo (i can imagine the giggling before i arrived) clothes everywhere, a huge bong in childs room in with teddies and sindys. Mess. Dirt. Rubbis overflowing.

i still saw the house

You say you like these people really!? You seem to think you have done them a massive favour and if they were such a risk as tenants why take them on? They have a dog, which is NOT against their tenancy agreement but apparently they are sneaky and dishonest. And they are scum ( in your tone) that they have been declared bankrupt because you know all it takes is to pays your bills on time and that wouldn't happen.

The biggest thing that annoys me personally is that you say you like them but there is always a but.... be honest you don't like them. They are income to you. You now want to sell and the dog shit etc is making it harder than it should be. Just be honest IME very few LL actuall;y care about tenants

you've decided to sell. So give them their notice, clean up and have the house looking great, sell. Seems to me you're just trying to squeeze more income out of the asset.

Why are you marketing the property to sell while you have tenants in it?

Surely it would be a lot easier to get them out, get the placed cleaned up (no shit on patio) THEN put it up for sale?

Tenants will put off a LOT of potential buyers and no buyer will exchange until there is vacant possession........ which is risky as your tenants can very legally drag their heels and decide they're not going anywhere.

If I turned up to see a house and there were tenants in it I would run away as fast as my feet would take me.

The amount you will get for the property for an empty, freshened up place, will be a lot more than a few months rent compared to marketing it when there are people in it who live with shit on the patio! Really you're not maximising your sale price here.

Newbrummie why don't you stop blaming the tenants and look at yourself. They have a pet, there isn't a no pet clause in the agreement, that's your fault not theirs. You haven't placed their deposit in an accredited scheme, they can fine you a lot of money. You seem a rogue landlord, I wonder if:

Are you even paying tax on your buy to let?

Have you got a buy to let mortgage or are you committing fraud?

Maybe this Aprils buy to let tax changes will catch you out with HRMC knocking on your door.

Anyone living in rented accommodation lives there as a home, their home - They may not own the property but they have rights.

The fucking snobbery on here is ridiculous, renting a home is really no different from owning one with a mortgage; If you want to argue that a rented home is not a home then a mortgaged home isn't either because the fucking bank owns it.

I really do hate the stuck up brigade on Mumsnet and OP you sound like you're gloating that your tenants are bankrupt, that's a very nasty attitude.

The tenancy agreement by your own admission does not stipulate that no pets are allowed, that's your problem, you made the mistake and if I was your tenant and you expected me to facilitate viewings so as you could evict my family and I, I'd tell you to fuck off.

I used to rent and my landlord was a vulture, no respect and no common decency; You sound similar OP.

In case I did not make things clear enough, ANYONE could lose their home be it rented or owned - Those living in rented properties have a right to peaceful enjoyment of the property and for that pay a monthly amount, similar to those who have a mortgage. However the fact is that if a renter can not pay the rent and someone with a mortgage can not pay the bank, the outcome is the same*.

The superiority on here makes me sick, being in debt to a bank doesn't make anyone any better than anyone else!

It depends if they are allowed to lie in the dog shit or touch it. You do not know and it really isnt anything to do with you. You want the dog gone because you are concerned you might not be able to sell the house. . If they stop paying rent you may find out it isnt quite as easy as you might think to get them out. Tenants quite rightly are protected from being evicted unlawfully from their home..

19lottie82....its just not that easy to get the tenants out and sell a house..How will the mortgage be paid with no paying tenants to foot the bill unless OP has plenty of money...? If the house take 12 months to sell, then Brummie might be in deeper doo doo than she is right now...pun intended..Chickens may be coming home to roost for part time landlords.

Just read a post that states that the op did not put the deposit in a scheme. Of that is true you will not be able to evict and sell the house.
See gov uk website.
If the court finds your landlord hasn’t protected your deposit, it can order the person holding the deposit to either:

repay it to you
pay it into a custodial TDP scheme’s bank account within 14 days
The court may also order the landlord to pay you up to 3 times the deposit within 14 days of making the order.

At the end of the tenancy
The court may decide that you won’t have to leave the property when the tenancy ends if your landlord hasn’t used a TDP scheme when they should have.

Wow! Well points to OP for perseverance. Usually when an OP gets so much abuse and told they ABU they do one of two things:

  1. Admit the errors of their ways and excuse their behaviour as stress/worry/upset/anger etc... (All perfectly acceptable human emotions)
  2. Disappear and not reply further (Also happens after number 1 when you get people who don't RTFT and keep replying to the OP without reading the OP's updates)

Option 3 being keep arguing your point that you are right is rarely a successful choice.

Well at least you made the right choice to serve them an eviction notice, you will find this will make selling easier. Could I suggest if you wish to get them out sooner, you suggest taking the last month's rent out of the deposit so that they have some money to get a deposit for elsewhere? My bitch ex-landlord allowed this when she evicted me to sell my home when my baby was only 3 weeks old. However, I had told her that I wouldn't be able to move as I didn't have a deposit if she didn't. Oh the power a tenant has at that point! It was also true, I was on maternity leave and every penny was accounted for and the eviction came out of the blue.

I have read all the OP posts and can't find one where she says she didn't but originally brushes over it as irrelevant to begin with, which had people assuming she hadn't, then she acknowledged that she had, many, many times.

joan exactly it's not that easy to get tenants out! That's my point! So surely better to get them out before trying to sell the house? There are so many related spanners that can be thrown in the works re the house sale it's unreal......... it's just common sense to have the property empty before putting it up for sale.

Any decent solicitor will advise their clients to walk away if they are looking at a tenanted property, even if the seller "promises" they will be out by a certain date. It's just not worth the hassle.
