TRying to sell the house with tenants in - undisclosed dog

So had a viewing at the house yesterday and the patio was covered in dog shit, as was the garden. I figured it would take a few months to sell so was happy for them to stay whilst it was on the market. Am now starting to think this is going to be impossible isn't it ?
Can I afl them to remove the dog for the rest of the tenancy ?

And that database (which I was invited to about five years ago) relies on the tenants giving their permission for data to be shared.

Erm how would the property being repossessed when you have a mortgage not effect your rating?

The council will not house you until the bailiffs have been. Someone I know left after the court date and before bailiffs came after he couldn't pay the rent anymore. He was housed temporarily while they investigated and then He was considered intentionally homeless as he left before the bailiffs came and social services only duty was to house the children. I.e he went on the street and the kids went into care. Luckily a family member took them in.

Well, it's their home to do as they want while they are renting it. What about that do you just not get?

brokenheartdog - sorry just read the rest, shouldn't have skimmed. That seems harsh considering care would have been more expensive than housing them, that wasn't what happened to the people I met in that situation not so long ago

No he did have kids. That was my point. He was told as he had left before the court date and balliffs he had made himself intentionally homeless (as the council presume notice could be revoked) and therefore the council had no duty to house him only a duty to house the children through the care system.

No, you know nothing about the law and you should never have become a landlord.

When I became a landlord I learnt the rules, regulations, joined a forum that would keep me updated and made sure that I emotionally detatched from my house and appreciated that I was giving something in return for money.
I was benefiting from it.

OP, MN is a real hotbed of landlord haters. I'm a LL and once posted about a tenant who didn't pay rent and the responses really attacked me for having the audacity to expect my tenant to pay. He then destroyed my house leaving me thousands out of pocket and a damaged ceiling thanks to smoking drugs, I used the word 'scumbag' in a post and got berated for it 🙄 People on here always assume everyone wants to buy their own property and won't accept that some are happy renting. I'm also an accidental LL and have been told on here that I shouldn't be renting my property out (despite being in negative equity if I sold) as in holding people back getting on the property ladder. Never mind that paying two mortgages would cripple us financially, as long as I have a clear conscience about strangers, that's what's important Hmm

However - with all due respect I think you need to brush up on your knowledge of tenant rights. You can't just "get them out quick" if they don't pay rent - the process means they could live in your property for 6-12 months rent free before you get a court order to forcibly remove them. They have to be 2 months behind on rent before it get the ball rolling. You can't just kick them out. If you tried they'd have every right to call the police, who'd rightly side with them, as it may be your property but it absolutely is their home and you need to treat it as their home.

It's not fair and LLs lose houses because tenants spend years sometimes not paying, but it's how the law is, and it's in place to stop unscrupulous LLs taking advantage of tenants.

If there's no "no pets" clause in the AST then they haven't broken any rules. However most AST's have a clause about keeping the garden and house in a reasonable condition and I'd certainly say dog shit everywhere is unreasonable.

They're really very good to allow viewings, they didn't have to agree to this so I would definitely ask them if they could clean the shit up from the garden but they certainly haven't 'snuck' a pet in so you can't challenge them on this. Also, arrive 30 minutes before the viewing to look round and check all is OK. It may mean picking up dog shit but if you want your house sold then needs must

It is their home but your property to sell. No way can you ask them to get rehouse their dog. You can however ask for them to make sure the poo is cleaned up tho, surely not unreasonable? You need to approach this very sensitively and make sure they agree to clean up after dog so ask them what would be a good time for viewings to take place? (ie. after they can clear up!)

I was a landlord but also rented, it's classic mumsnet to call anyone who pulls landlords up on their behaviour a 'hater'.
I think that there are far worse landlords around, I have been posting for 14 years on here about it and still, we get posters saying that they can enter with 24hrs notice etc.

I don't believe that most people want to rent no, it's an insecure lifestyle and you are at the mercy of people who can give two months notice and ask you to leave your home.
No pictures up, no devirating, no pets.

The worst thing is that many act as if they are doing the tenant a massive favour too.

I have had a bad experience with tenants too but I still think that they are far more vulnerable.

The point you're missing is that there's been no "behaviour" by either side, all these fun alledged agreements and court battles and bailiff are figments of people's over excited imaginations. Most tenants are cnuts and will just go especially mums who want a nice home for their kids not a b&b in depths of where our local council would send them

The point your missing newbrummie is they might not have a choice. A bankrupt couple are going to struggle to find a landlord to accept them and at least a grand deposit and bond. They might have no choice to wait it out.

You say you know the law but you keep stating incorrect stuff.

I'm going to end up an accidental landlord in a couple of years as will inherit property so not hating at all.

Please ask on the landlord zone forums if you want facts.

I do fully appreciate it'll be difficult again, that's not a situation of my making. And it'll only be worse for them and their guarantor if they do start playing silly buggers so I'm confident that even if they sit it out for their own good they'll keep paying
