Please tell me who ruined my phone - me or my husband?

Please can you lovely people of mumsnet settle an argument that has been running on a for a week or so between my husband and I -
We were having lunch last week with bottles of coke each, we discussed carrying a few things home and I said I would put the bottles in my bag (so I had hands to carry other things). Unbeknown to me my husband had just 'rested' his lid on his bottle. At end of the meal I collect the two nearly full bottles and put them in my bag as discussed. To me at a glance the lid looked on. It then leaks, going all over my bag and ruining my iPhone (it can't be repaired - major upset).
Who broke my phone?!
Him for not screwing the lid on properly (i'd say why put it on at all if you aren't going to put it on properly?! He says he didn't want to lose lid hence why just put it on loosely) or me for not checking when I put it in my bag? I wouldn't check normally because I would always put a lid on properly or not at all! Plus when discussed putting drinks in my bag he didn't warn me about lid.
Go to town pls! We can't agree at all! Please provide a judgement so we can move forwards :-)

Taking the same approach as in any "accident diagnosis" if any party can (reasonably) prevent an accident and doesn't; they're both culpable.

So - your husband should really fully close the lid as his bottle, but also ideally you should check as your bag.

Also, as mentioned by PP - allocating blame is not going to fix your phone, so, claim on insurance if you can. If not, talk nicely to Santa :).

Also like to say DH put mine in the washing machine once when he had to wash the bedding after I was sick on it. It was an accident, I shouldn't have left my phone there, he could have shaken it out but shit happens. We both felt guilty!

He didn't want to lose the lid so he did what would make it more likely to be lost, put it on loosely. Idiot.

Did you both bring your own bottles of cola to a restaurant, then leave with the remnants of said cola in your bag? Or were you having a (slightly chilly) picnic lunch?

This is important to me, otherwise I cannot ascertain a clear view of the matter in hand.

You are both equally at fault for drinking coke.

It is filth and has no place in anyone's diet (unless mixed with rum, whisky, pernod or vodka, in which case, as part of a balanced alcoholic diet, it is just about acceptable.)

him. Is it a weird male trait? My ds does this with huge jars of nutella. i pick up the jar and it just slips out of my hand cos the lid is only rested on. WTF would anyone do that??? Angry

My phone has been dead for 3 weeks OP: I feel your pain.

Him. Definitely him. When you offered to put his bottle in your bag he should either have tightened the lid himself or told you it needed tightening. But lesson learned - don't ever offer to carry stuff for him again!

Oh god, it's annoying isn't it?
One of my DC chucked their water bottle in my handbag once at the park and it leaked all over my phone and fucked it up!
I was annoyed with myself for not checking at the time. But yeah, it was an accident.

Yesterday, dp said he couldn't take ds to his swimming lessons as he was working. I took ds, dropped my phone out of my bag and it smashed on the floor in the changing rooms. I felt a little unreasonable but I blamed dp when I got home because it ended up that he was home before I even took ds swimming, so he could have done it in the end and I wouldn't have smashed my screen again . Although in reality, I made a silly error and it was my fault! (Still secretly blaming him though!) I have booked myself in to an apple shop for a screen replacement Sad

The restaurant is BU. For selling bottles not cans. Tastes better in a can and you can't leave the lid on/off because there isn't one.

Well, if you must insist on paying over the odds for an iPhone, you need to check what you put in your bag with it.

I don't understand- how does tightening the lid fully cause the drink to lose its fizz? Surely leaving it on loosely will do that?

It's both your fault.....
his 30% for not putting the lid on properly. He would still be in the 'wrong' if this incident had not occurred as the drink would have either spilled anyway or gone flat.
Yours 70% - for not checking the lid was on and cos ultimately the buck stops with you re being responsible for your property.

As it was a genuine accident, i would ask him to contribute a third towards the cost of a replacement phone of your choice.

However, having to take the hit really does take the piss and i too would feel it's unfair.
So, because the drink/property would have been ruined anyway, it's only fair he be responsible for helping you get over this injustice.....at least one awesome orgasm a day...foot/back/whole body massage at your request...breakfast in bed every day.......Xmas Grin Xmas Grin Xmas Grin

If you have an iPhone, get an Otterbox when you're getting the screen replaced. They are worth the money as they protect the phone from bad falls (on tiles, in the car
park, etc.) as I've found out from experience.

I feel your pain- not made easier by the fact that you're both to blame! I'd never put a drinks bottle of any description into a handbag, as even when the lid seems secure, they can still leak. Adopt this policy in future, and either finish the drink or carry the bottle in your hand. Better a little inconvenience than a ruined bag and contents anyday.
