I have a 16 year old boy and find this really really upsetting. AIBU to wonder has the accuser suffered any consequences?

Granny yes he is appealing, there were lots of phones seized (15) but only 3 data interogated all of which post 2010 (they were together 2005-2013). All charges after 2010 dropped so he is appealing on the grounds the police wouldn't release the other phones or get the text messages from them to show a true reflection of the relationship.
mammoth he pleaded not.guilty to all but it was obvious she was lying post 2010 due to.the text messages and her diary which was 2011-2012. She got pregnant again during this time and sadly miscarried but claimed her and my partner had not had sex on over a year so he must have raped her however her handwritten, dated diary stated that she had never been happier and more in love with him and that they were desperately trying for another baby. She even went to the doctor to request IVF which was on her medical records. All of this gave the jury reasonable doubt but the judge directed that each charge nut be taken on its own merit and considered individually so although the defence could make a good case against these charges it was almost impossible to make a case for the others. My thinking is that the jury were afraid to give a fully not guilty verdict for all charges in case a guilty man walked free but even then it was not unanimous (10-2 majority after days of.deliberation).
The system is supposed to be that the prosecution must prove a person's guilt beyond all reasonable doubt but in reality it doesn't work like that,the assumption is that the person is guilty and they have to prove they are innocent but in these kind of cases how can a person do that?

mirime, no she hasn't been found guilty of anything. People shouldn't be making that judgement about either of them. It is often difficult for a jury to make that decision when they have all the facts. Hopefully no one on a jury says that the chances are he's guilty because false allegations are rarer than rapes.

I've just had a look over on Digital Spy and I can't find a thread on this over there yet. Which is surprising considering they usually love stories like this.

I suppose really only the two people involved ever really know if it's false or not. My feeling was by false he meant the accusation was taken back, but as I didn't interrogate him or ask further questions as I was paying for his time to sort completely unrelated issue. He had a habit of waffling on my money.

The main fault i find is in the reporting. The title says false accusation. Not reading the article i could go on a massive rant of how awful the girl in question is. And then there's a small line that the accusation was actually withdrawn,but no mention of the reason. It's a massive,misogynistic and patronising assumption to make. Unless stated by the girl/police it was withdrawn BECAUSE it was false,they don't know. Neither do we. Withdrawal of an accusation can be for many reasons...lack of support,intimidation by family or others (i got in massive shit at home for reporting an assault,and the option of reporting sexual assaults i've been a victim of was never even mentioned), the daunting process of giving evidence and going through a trial, being told there's not enough evidence, doubting yourself due to victim blaming etc. False accusation is just one possible reason out of many. Why is it the go to reason?!?

Op what consequences? Withdrawing your complaint is NOT a crime. Many dv victims withdraw their claims,even though they're black and blue and everyone can see it happened. It happens so much that the law has changed and the police can press charges even if the victim refuses. Are all of them false accusations too? Should there be consequences?

So, if the accused is innocent until proven guilty, and therefore the accusor innocent of lying until proven guilty, is there no longer any allegation at all? Hmm

Soooo many people not understanding what innocent until proven guilty means!!!

Innocent until proven guilty in the eyes of the law. Legally,they won't be punished until proven without a doubt that they are guilty. That doesn't mean a rape victim who's attacker was found innocent,on a technicality,or based on evidence(he said she said are awful for this) or it didn't even get to trial, must bow her head in shame for lying or shout out loud oh sorry my bad,i obviously was NOT RAPED. Or that any criminal is any less of a criminal just because they weren't caught. It doesn't automatically mean the crime didn't happen,or that he didn't do it , just that he cannot be punished for it.
There are thousand of women who have been raped and their rapist has not even seen the inside of a jail cell....legally they're innocent,doesn't make them any less of a rapist.

Weirdly, people only ever think the one accused of rape is innocent, not the one they are accusing of lying. I wonder why that is...?

This story really got to me.

A mother and son dead and a "pick your camp" attitude to a story we'll never know the truth behind.

It's utterly tragic.
