Who is BU, re end of tenancy check out

Hello everyone, please give your opinions on the following situation.
We are moving out of the rental property on 18/07, our normal pay day is 19 of each month. The agreement was that the checkout will be on 20/07. The agency wants us to pay £65.00 for that additional day. We agreed and said that we would like the checkout at 4pm at the earliest as we both work and just physically cannot be there before that time of the day. The agency rejected that and said that it will be at 2pm and that's final. Then we suggested to do the check out in the late afternoon on 19/07 and then we will not pay the additional fee of £65.00. They rejected that as well. Then we said we will try to make 2pm but only pay £30.00, as it is quite early checkout and why we should pay for the whole day. They rejected this again. After the emailing them back and forth my DH said that we will vacate the premises at 23.59 on 20/07 and will send the keys by recorded delivery. Checkout will be at any other day after that. Waiting for the reply on this one now... Just wonder where we standing in this situation, really...

Tessa is not saying that's a legal situation, she is giving her opinion. Lots of other housing lawyers disagree with her opinions, I have followed her for years.

OK Studios, move to Scotland in the short term! But

It only benefits the landlord as they cannot claim from the deposit without proof/inventory. Which is why, imo, there shuld be legislation to say that the LL should always pay for the Inventory and share Check In/Out with the tenant.

Tenants should not have to pay admin costs because a landlord has chosen to use a particular agency. OK... would you include referencing and right to rent in that?

And no one suggested that those suggestions are the law, we have all been talking about the possible regs, the common practice etc.

And yes, just pay the rent.. which will be raised to cover such costs.

Not all LLs an LAs are unreasonable gobshites, we need better regs, not more but regs that are there for both LL and tenant. The current slew of new regs does bugger all for either.

ourblanche I have been a landlord for twenty years, I still think that the tenant shouldn't pay admin costs.
Not sure why you put the unhelpful comment about moving to Scotland, I responded to your question with my reasons why.

I paid 70k to my landlord over two years, I am sure he can cover the £290 check out costs and it wouldn't be necessary to rise the rent to cover it.

I wonder if I will get called a landlord basher in a minute? Hmm

Many LLs agree with you and self manage. Some can't or don't want to. So agents will probably always be with us... there will always be disagreement as to who pays the fees. The best fix at the moment is to be equitable... as per the law I quoted earlier.

One person's experiences are never going to make a law, so it really doesn't matter what you paid or are paid. There is a service industry surrounding renting... it isn't going to go away.

I can only repeat we need better regs, not more but regs that are there for both LL and tenant. The current slew of new regs does bugger all for either.

And if you are called a LL basher, it won't be by me. I detest such posts with a passion Smile

I've checked and LL paid for the check in and tenant should paid the check out fee.

Then you could buy your own from A N Other clerk. They only need copies of the Inventory and Check In... TDS would frown upon them demanding they insist on their own clerk.
