More of a WWYD... Waitress dropped dish of olive oil onto my phone, now it's broken.

She was very appoogetic, and I wiped it over with a napkin and turned it upside down, but the oil has obviously got in to the piece where you hear people talking to you and you can't hear anything. So essentially, I can't make or receive calls.

Is there anything I can actually do about this? I mean, they're not going to replace my phone are they Confused... Is it just bad luck and move on?

The restaurant should have insurance to cover this?

Yeah, I'd contact the restaurant and ask them to pay. Might get the waitress in trouble, which is a shame, but no you shouldn't have to just accept this.

I'm not sure waitressing is for her to be honest... Previous to this she dropped our bread and my DD's drink.

They should have insurance, but I'd also say that in an environment where drinks get spilt and stuff gets dropped you should not have gad your phone on the table in the first place.

Well, I just called them and the manager said 'I'm not sure what I can really do about that. I'll certainly have a chat to the staff about being more careful.'

Try Head Office. Sounds like the branch manager has admitted liability but doesn't have the necessary freedom to act.

But you need to be clear - what happened (waitress dropped dish on phone), impact on you (phone doesn't work), what happened when you complained (manager said they'd be more careful), what you want to happen next (chain to pay cost of repair/replacement).

I'd write a letter to the restaurant and CC head office.

ASK should have enough money to buy you a new phone, I would insist.

I'd also email head office as its a national chain. Give them a reasonable amount of time to get in touch and then take to social media.

I was thinking what Pottering said...I think an environment where food and drink is being carried, you had the phone out on the table, they might well say the risk is yours and you should look to your own insurance.

Their answer wasn't good enough.
Phone back, tell them you expect your phone to be replaced.
If they refuse, go up the chain of command.

Mary, I'm not saying you shouldn't have your phone on the table
but you should have insurance for your phone if you wanted it?

also, wait staff have to contend with a lot - realistically the chances of a spill are always there, I think it's a fact you have to accept when you go to a restaurant.

Maybe they will pay up, I don't know, but I'm just thinking they might ask about your insurance. Your mobile might be covered under your home insurance.

Phone the restaurant back. Ask for the manager again and just say you are calling for clarification that your property was damaged and the only thing that will come from this is staff told to be careful. That the cost of repair/replacement will not be covered by that branch.
They will admit this and chances are ask you why you want to know.
Tell them you want to be clear before you escalate this further.

But surely you don't use your own insurance if something is damaged by someone else who has insurance. That's the point of having insurance isn't it?
