To be pissed off at having just seen my tenants spending a load of cash whilst they're behind on rent?

I am fed up to the back teeth.

This is the third month now where they're falling behind.

(I know them by their appearance and we have a mutual friend on a social networking site)

I have just seen them paying for a spa and no doubt it'll be up on social media next week (they like to brag and display all their newly acquired gains in Instagrammed glory.)

Next month my kids won't have the birthday parties they wanted because I'm subsidising these idiots living expenses and incurring charges as for their late/part payments. Angry

Has anyone managed to get tenants out despite then not being 2 months late on rent. The Lettings agency have told me I'm stuck with them . Can I fine them?

They got a 12 fixed contract in January and surprise-surprise they started to default from day one of it.

I'm so upset.

Handsoff apologies if I have misread your posts. Your earlier posts made it sound to me that you thought you were relying on those contract clauses to evict tenants, and I just wanted to clarify.

I think it's to do with statistical likelihood of non/late payment and the defaults that can occur as a result of that. Not classed as discrimination at all and well you only have to look at the majority of govt fiscal policies to see that disadvantaging poor people is just fine and dandy.

But anyway loads of people clearly get around it if there are close to 5 million people claiming housing benefit.

That's ridiculous and unacceptable Martha. How the bloody hell do people manage if they just need a stop gap?!

It is, but when there are more people needing homes than there are homes the ball is in the LL/LA court. Its not worth the risk of looking like you will be an awkward tenant by asking for a shorter tenancy. They'll just write you off and move onto the next application.

I had my name down to view this house (well any one of the ones that were built tbh) before they had even started building it, before they had even been bought, before anyone knew if there would be any rental houses among them. Blush i called every single week to make sure my name was rolling off the EA tongue as soon as they thought of these houses. I started saving to have double deposit plus first month's rent plus rent to cover overlap in old house from as soon as i heard there were houses being built. And i made sure EA knew that i had it and was ready to go. I made sure i was in the office as often as was reasonable so they knew my face, knew i was presentable and serious and so they would ask around to find out who I was. competition was so huge for these houses that there was stil no guarantee at all that I would get one. They were concerned that as a single earner with childcare costs i couldn't manage the rent, especially as previous house was a few brackets lower in rental rate. (Thats where my proof of saving came in to show i could afford it).

Horrible situation op. I hope they do pay what they owe. Not the end of the world if no party thought. Sounds like you need to sell it as your not suited to btl.

Yes but surely a landlord would be assured of the rent if they knew a tenant was on housing benefit and it was getting paid directly to the landlord. I remember years ago most ads advertising flats and houses would stipulate "no dss"..... then when the HB rules changed, paying landlords direct, the ads would say "Dss allowed". I still don't understand why it's changed again. I know if I was a landlord I'd sooner have someone on HB (if the rent was being paid direct to me) than anyone else.

Thanks this thread HAS been an eye opener and don't concern yourselves too much (posters who expressed this) not upset by the chippy comments at all now. Grin

My tenants had x2 of 6 month contracts. Then a 12 month. A mistake. I'm not going into any more detail as I've said enough but thankfully missed more information than would be wise to share. I have combed the contract and researched the Housing Act so feel so much better. I have always had a contingency a big chunk of which was used to make essentials repairs. I have money ear marked for other things too but the fear of things going really wrong (like last time)is what made me panic about spending on anything unnecessary until I have a handle on the situation.

I've skimmed a few posts and there was a mention/criticism about grammar- I do hope that was for me. Might not be able to type very well but I have managed to have a fabulous life anyway (with no mummy and daddy or inheritance) so a big fuck you to the nasty contributors.

Best revenge is living well. The accidental LL business isn't for me but I'm a fast learner and I'll enjoy the moment I get my house back which I will. Trashed gardens, filthy rooms and demolished walls can be fixed with my hard work- I've done it before and will continue to work hard to provide for my children.

With regard to housing benefit, LL are not keen to accept this as it's paid in arrears. As well as mortgage lenders stipulating not to let to DSS tenants as part of mortgage agreement.

LL can generally pick & choose who they want for tenants (supply v demand) so don't choose DSS tenants.

Some people are just bitter cunts, it says a lot more about them than you.

Hope it all works out and they start to pay what they owe you, and you can boot them out at the end of their tenancy and give them a poor reference.

If there not paying thte rent then i think it's time they leave. It's a privilege they have got a roof over there head but if they can't be bothered to pay the rent they shouldn't be living there.

AyeAmarok, are you reading a special version of this site? If not, then I applaud your perceptiveness in being able to see what people are really saying, despite them saying something else entirely, in terms of words used, content and overall meaning. I've heard that one can read thoughts if one simply adjusts ones tinfoil hat to the correct frequency, thus dispensing with listening/reading to what a person says altogether. Is this what's working so well for you?
