AIBU to ask if Ched Evans conviction is overturned...

That he should then be allowed to continue his life as normal?

Or will we doubt the credibility of the appeals system?

im interested to know what you might think would make his conviction get overturned?
His website thinks that there was some sort of dodgy messages that the girl sent her friends on facebook, they are holding out for one of her friends to come forward saying here's a message that she sent the following morning saying how she'd shagged a footballer and loved it...
That'd change the story that she was too drunk and couldn't remember. into some sort of story where she regretted having sex with two guys at once and so decided to cry rape.
(except she didn't "cry rape" she was clearly very drunk, everyone knows this, including his mate who was in the room and asked the hotel to look after her, and including Ched who fucked off out the fire escape)

I don't think the appeals system can fix that sort of fucked up.
exactly, yet he has ambitions of being (like most footballers) a "hero to school kids"

he has ambitions of being stinking rich. HAD he held up his hands and admitted to rape, been mortified and showed remorse i might have given him the time of day. might! he hasn't.

All that Knifey says, and indeed why do we need a plethora of threads on the same issue essentially. MN could gather them together. The CCRC are wildly unlikely to provide comfort - IF there were some volcanic new evidence OR a poss reinterpretation of summing up or some nuanced judgement it would have been played out by now on his web site. It's all tiresome wrangling.

Funny how all the bad publicity and the not getting the job with Oldham seems to have caused him to think about the victim at last.

He admitted he raped her, if somehow it does get turned over it will not change my opinion of him or those who hold his favour.

My friend was raped as a child, I detest her abuser and wish he would do a justice and take a long walk off a short cliff- despite the fact the case was dropped.

By his repeated refusal to accept he is guilty he is saying it isn't rape to have sex with someone unconscious and/or unable to consent. Everyone who supports getting his conviction overturned or him himself, knowing that he convicted himself with a confession of his actions...I feel for their children and those vulnerable around them.

My friend raised something to me, for everyone who supports him: imagine he becomes a footballer again and a role model. Your DC have his picture on their wall. They want to be him- want to be a rapist- they want to be with him - want to be with a rapist because everyone makes 'mistakes' and they should forgive their partners if it happens to them. Your DC grow up seeing him and believing it's okay to rape if you have enough money, if your famous enough, if you can scare your victim enough and they grow up accepting that their rapist can walk free, could show up as a role model on their DCs walls.

And if that doesn't make them think: your DC is devastated because their rapist walks free, you reassure them that that's okay- after all they've done their time.

It should't have to be about someone elses family or DC but when someone posed this to someone I know, they suddenly had a change of heart about rapists. Hypocrites.

He was convicted of rape BY HIS OWN WORDS in his police interview so he doesn't have a hope in hell of getting any conviction 'overturned'

If it's overturned I would respect that and just back off and leave him to get on with it. I have a bigger issue with the clubs happy to sign a convicted rapist and putting goals and money over the victim and all their female and child fans.

No. He has had his leave to appeal turned down twice...in other words, an appeal wasn't granted as no new information came to light.

Can I just ask, if the CCRC once again rejects leave of appeal, would he be able to submit again? Can he just keep applying to the CCRC so that, in the eyes of the public, he is in a perpetual state of appeal, thereby always making the public think there is an element of 'doubt', otherwise why would he be able to appeal (because most of the public do not understand that at the moment, he is taking the route that any convicted criminal could choose to take, it means fuck all).

I guess even Karl Massey would hold his hands up at some point and say 'ok, enough now mate, I'm not wasting anymore cash on this', but you never know...

How can it be overturned when him raping her is on film?

Him and his family seem to think the legal system works by if you commit a crime and whine about how you don't like the fact you were caught enough you get let off.

No, you cannot keep going back, unless you have something new that you could not have known about.

So techical arguments about the law of the land as it stood at the time of the offence (ie the 'this is what I testify I did, but it's not rape really') won't arise again - that's been extensively picked over by senior legal figures.

New evidence? Possibly then a fresh appeal (which can then be reviewed again by CCRC when unsuccessful).

But remember, this is all about whether CE could reasonably have believed she was consenting. The three people in that room, the two filming what was happening and at least one member of hotel staff have all given evidence about what they did, saw and heard.

What really are the chances of a so far unknown witness to the events emerging?

The chances of the CCRC referring this case to the CoA and the Court allowing the appeal are this to the point of emaciation. Frankly, there is more chance of the sun rising in the West tomorrow. Not a matter to worry about.
