to refuse to refund this ebay buyer unless they return the item?

Sold some shoes BNIB on ebay. Buyer now says they have been advised by Schuh that they are fake and demanding a refund without return. Says ebay have told them not to return as I could sell on!

Can't believe Schuh even offer this service, and buyer has no written proof they wee told the shoes are fake. Shoes came from a relative so no idea where they actually were bought. But buyer demanding full refund without returning them. On hold to ebay now but suspect MN will be faster!

It just sounds like a scam, insist they are returned to get a refund.

Where did you buy them, and did you use a credit card?

Say you will very happily refund when you receive the item back. Be a bit wary though, I think if an item is thought to be counterfeit it goes to eBay and destroyed.

Oh got through to ebay. They say no refund without return. And they say there is no record of buyer contacting them.

Tell her to damage them (cut the straps) , take a photo then you will refund her. At least she won't end up with a free pair of shoes

Jeez, there's no end to the try-it-on brigade is there?! Still, you've got their money, they can't make you refund it and it doesn't sound like eBay would support them if they tried to launch a dispute.

Surely Schuh would stop the conversation at the stage of asking "do you have a receipt?". The idea that the shop would consider a return without proof of purchase, but then notice that the shoes are fake, seems laughable. And the argument about why they can't return the shoes to you is silly. If Schuh were concerned about the fake shoes being resold, why not call in the police to collect and dispose of them from the shop? Hopefully ebay will sort this out quickly.

If the buyer opens a dispute claiming the items are fake, and eBay agree that there is evidence the items are fake, their own policies state they don't require the buyer to return the item to get a refund pages.ebay.co.uk/help/policies/money-back-guarantee.html

If you feel confident they aren't fake then insist that the buyer either returns the item for a refund (if you want to do that), or opens a case through the resolution centre. Yes it'll probably end in negative feedback but these things happen occasionally, unfortunately.

Waiting for Ebay to get back to me now, they are looking into exactly what communication buyer has had with them. But they said that there has been nothing in the last 7 days so they are def lying about having already contacted Ebay as shoes only sold on Thursday

I didn't buy the shoes myself, they came in a bag from a relative who was moving house and wanted rid of a large amount of clohtes/shoes etc. Relative is well paid and has a lot of designer stuff so I seriously doubt they are fakes but of course I can't actually prove it.

Ebay saying they must return fully tracked at their cost.

I recently paid PayPal for something which was an obvious fake (didn't go through eBay though but via another site in my country which eBay owns). Opened a case with PayPal and you bet they made me return the item before I got a refund! I was fuming actually because I know the person will just sell it again, but they certainly weren't going to simply give me a refund and let me keep the item, fake or otherwise.

This person is trying it on.

Well I can't prove that they are genuine but I doubt they are fakes iyswim. It never occurred to me that they would be.

Does anyone know if Schuh actually offer a shoe verification service though?

Cross-posted. But yes I had to return fully tracked at my cost and provide proof of delivery, not just of sending, before I got my refund.

My friend used to work for a v v high end brand and they used to refuse to authenticate or give any opinion to a customer as to whether their handbag was real or not. At best they were told whether the serial number was in the same format as their bags. I don't believe for a second that mass market Schuh are telling your eBay buyer anything about your shoes based on a photo from eBay. Cheeky bugger for trying it on though!

No, they don't. They simply aren't high end enough and even if they did they wouldn't have done so that quickly.

Ha. Ebay have confirmed they need to return item or no refund. They also said buyer would need actual proof of them being fake to win a case.

And... I spoke to Schuh. Who are emailing me to confirm that they do not offer a shoe verification service and that the buyer is having me on.
