To buy this land and risk upsetting the tenants next door

Long story short. My house is at the back of a large house which was converted into flats last year. I own the freehold to my property and have had problems with the tenants of the flats parking on what is actually my land. It got bad when the LL of the large house 'rented' a part of my property to one of his tenants as an extra parking space and it took a long time and solicitors letters to get it all sorted.

I also had to spend money on getting bollards and a fence to ensure no-one parked on my property.

My property is at the end of a T shape and I part is used as a passage to my house ( I have legal access over it) and a parking area for 5 cars rented by the LL to his tenants

However because of all the problems my solicitor has done some digging to ensure my legal right of way and that nothing comes back to bite me on the bum with the owners of the large house.

It then got interesting - it seems that the LL bought the large house at auction on a 99 year lease. My Solicitor saw the legal pack and there was no mention of the land on the paperwork.

He has now found out through the freeholder that the land does not actually belong to the large house but to the house next door.

The freeholder of the house next door has confirmed yes its his land but as he does not live in the house was unaware that the LL of the large house was using it as far as he was aware only I had access to it.

He has now contacted my Solicitors and offered to sell me the land, If I don’t want to buy he is going to offer the LL the chance to lease it from him but if he does that I am worried about my own access across it.

I am very tempted I can enlarge my garden and my husband (who rents a garage ) can also park his car on the property we can afford it and it may increase the value of my house and provide a safer environment for my DS and bump when he/she arrives.

But that is not going to sit well with the tenants of the large house and I can forsee huge problems with them as a couple were very abusive to me during the problem with the parking before.

I have a couple of weeks to decide. I know it would not fair to the tenants but its something they will have to take up with their LL as either he has been badly advised/mistaken or is chancing his arm renting out parking spaces when he knows its not his land (I suspect the latter).

According to my Solicitor there would be no legal or planning issues if I wanted to change the area to a larger garden (although I will check with the council myself)

So would I be UR to buy it

Buy it, and don't talk about it until it's done. Once all totally finalised then issue notices to the tenant that in 6 weeks time you'll be fencing off the area as it belongs to you and then fence whole area off. Also inform the landlord.

That is the best case of RTFT I have seen. Foreverondiet I would actually be proud of that.

I am guessing that at that early hour she didn't spot how long the thread was. I have done that myself!

Mumsnet's software really is rubbish: I post in another forum, the software for which doesn't let you post until the end. Threads are much shorter and more interesting as you don't have lots of repeat advice nor any 'RTFT'. Also you subscribe to threads and use the 'check subscriptions' button which takes you to the next post since you were last on a thread.

Bearleigh You can bookmark threads so you automatically go to the last post you read just by clicking on the thread titles. Just hover over the last post and a little button will appear in the bottom right hand corner

I thought they knew this morning OH is in the dog house and in serious trouble ( I had dived headfirst into the loo this morning only to come face to face (as it were) with a huge poo he had left in the pan without flushing dirty sod) so as its sunny has taken himself out of harms way into the front garden area killing time until I have forgiven him (any one know the exact date when Hell will freeze over?) I saw bin lady come over and start having a go at him, but it turned out it was just about the bin so sorry no more news.

Have taken pity on OH and will make him a cuppa will let every one know what happens with the tenants as soon as I know.

Because I'd have been happy to let rant all they liked and then let them know that the land was mine and that they should be getting a letter about it soon.

Because they should hear the news from the person they have their contract with, the landlord, so they can direct their ire in the appropriate direction.

They'll be pissed off with the OP, obviously, but it's probably best to keep it as much as possible to formal channels to reduce the amount it becomes personal between the OP and the tenants.

Blimey these tenants are going to have trouble picking their chins up off the floor.

I just can't imagine wanting to be so difficult with any neighbours, some our neighbours visitors park selfishly etc. it irritates me but just let it go because life is just too short!

I can't blame the tenants for being pissed off but that should be with the landlord not you.

It will be sweet to smile at bin woman and the other couple that parked outside your house. Enjoy!

I bet you anything the landlord isn't going to tell them. Why would they? They're going to see it as a problem between the tenants & yourselves and expect you to sort it out. Give it a few days but don't let the landlord get away with it.

Well it depends if he's going to keep charging them to park on your land. He's got away with it under the previous owner, but not anymore.
