To think eBay has let this scammer get away with it?

Dh bought v expensive rare thing at bargain price. It never turned up.

Seller claimed it was delivered and signed for - on a day we were home, and in name not ours. Neighbors don't have it, Royal Mail say that tracking no didn't go through our local sorting office. Seller went silent.

Our theory is he sent something, somewhere in order to claim it was lost and sell again.

Opened dispute, got mail yesterday thanking dh for his patience and efforts to communicate with unhelpful seller.

Mail today: THEY HAVE RULED IN SELLER 'S FAVOUR because he provided tracking details. WTAF? Scamming little wankbadger now has item and money, with ebay's help!

if they have a tracking order surely it states it was sent to yours?

if it isa lost surely rm will copver it?

He has never provided any proof that it was sent to our address, just says so in email.

As such, he's saying it's not lost so no claim.

Open another dispute if you can, and say royal mail have no confirmation of it, how long has it been?

A month, and yes paid PayPal - is that process any different? Just concerned we've fallen foul of fairly clever scam - send empty box to random address a few miles away, eBay won't look into details of tracking.

What address did he provide and how many tracked items did he post that day? I've know one seller to send out three things (things were won) and tried to use the tracking no for a toy to prove that some jewellery had been sent. Not the same address and ask pointed out, not the same value on the tracking.

Did he provide you with a scan of the tracking paper or just the number?

No no - eBay will have seen this scam before. Do NOT give up - keep on at them. Appeal it. Badger Customer Services. Use the Live Chat. Make another complaint through PayPal. And get in touch with Royal Mail saying you suspect a crime has been committed. And if needs be the Police too. These fuckers only get away with it because people give up - so please don't give up!

You could always try them, my mum and stepdad always get claims that items havent been received, but normally when the item cant be traced anymore. So you need to act quick, soon they wont be able trace and then your stuffed.

No scan - we've asked several times. Just number. EBay might have seen this before but they don't seem to care! Am shocked, tbh, that they've taken his word for it.

agree re opening a second 'wheres my item' thing in paypal. they seem to go more with the buyer. and they hold the pursestrings too. the possibility of having their pp account closed might put the frighteners on the seller.

when you look up the RM tracking number what does it come up with?

I think that you can do more with the tracking number. Is it a royal mail service? If so they will confirm dispatch time,date and address, the. The date, time and signed for name the other end, plus any information about the estimated value of the content. You can then make a claim via the royal mail if the signatory isn't the addressee or if the parcel was delivered to the wrong address. You can ask the seller to provide all of this information and if you suspect theft call the police for a crime number.

If this isn't royal mail check what service was used and what insurance was included then make a claim against them. If a tracking number proves invalid open a new case on eBay and get crime number.

Right, dh just off phone with Royal mail who confirm it looks like they've made a mistake and delivered to random address 3 miles away. FFS.

Problem is, isn't it seller who must claim? And seller clearly doesn't give a shit, not responding and now has eBay ruling in his favour. Will PayPal be more helpful?

Can you go to the address to ask for your parcel? If not ask royal mail for their claim form.

Also send a very apoletegic email to seller explaining what's happened at Royal Mails end. Might get him to cooperate more?

This happened to me. I made an appeal, and then actually telephoned ebay to explain the situation. They overturned the ruling and I was refunded. Good luck!

Ebay has replied to DH, saying they understand, thanking him for his patience and recommending he speak to the carrier (he has, twice) and ask the seller to supply proof of postage (done that six times already) - both of which he's told ebay repeatedly, so I'd question whether they do 'understand'.

So basically, it seems as long as the seller has posted something, somewhere, eBay will take their word for it. And if you have a Royal Mail mistake and an unco-operative seller, you're stuffed. No money, no item.

Hugely unimpressed. DH will take a drive out to location of alleged misdelivery later today if he can, but really it should not come to this.

Ebay are based in the fillipines and are notorious for not grasping the basics, and ruling in a mad, mad way on disputes.

If you want a better job done then always open a dispute through paypal, NOT ebay.

Paypal are UK/Ireland based and as such they can hold a conversation complete with subtleties and colloquial language. You get a person with paypal, and they are normally fairer (unless your buyer tried to scam you, in which case they can come down heavily on the buyer's side)

TheCut, Royal Mail's mistake is not the seller's fault - but absolutely refusing to supply postage details or anything that might help us make a claim is at best bloody unhelpful, and at worst spiteful.

It would be no skin off his nose, would take two minutes but I presume he's got the arse because he didn't make the price he wanted. Which isn't our fault - he was too tight to put a reserve price on.

Legally, Contract requires seller to get it to you, not your problem if courier gets it wrong. I know this to my cost. I think Ebay is just very automated in how it solves things. You do have a very solid case but fighting it is tough.

The seller is responsible for delivery - they chose the courier and method of dispatch so they are responsible - this is their fault. You will not be able to claim from Royal Mail because you have no contract with them in this instance - it is the seller that would need to make a claim. I would try e-bay one more time, them go down the Small Claims Court route.
