To not pay this parking ticket from Total Parking Solutions because its a scam?

littlejo67 · 22/06/2013 18:01

There is info online saying this company is unethical and don`t pay, but ts difficult when you get threatening letters to find the courage to ignore it (thats the ploy apparently).

I have been ignoring Parking Invoices from Total Parking Solutions (TPS). I have now received a letter from Debt Recovery Plus a "Notice of Intended court Action". It states if I don`t pay £148.00 it will go to the creditors solicitor to commence court proceeding.

Apparently I have ignored a previous letter from them - but this is the first I have received.

The original parking invoice was because I stayed 20 mins over the allowed time in a Health Centre car Park. The Health Centre has a Boots and two Dr`s Surgeries on it. So I guess that they are the clients of TPS.

I work from one of the Doctors Surgeries- I am not employed by them but work as a therapist with their Patients. I was asked to come in by the Surgery for an I.T induction and I parked in their car park.

The Car Park was free so there has been no financial lose on their clients part, plus I was invited by them (but I should of noticed the cameras I guess).
Therefore should I just keep ignoring this?

Anyone else have a ticket and it went away? Hmm

burberryqueen · 23/06/2013 08:19

exactly, pay council tickets but never those from Parking Eye or this TPS, they will do precisely sod all.

McNewPants2013 · 23/06/2013 08:30

I would just pay it, as if they can take you to court.

It could be argued that the money is the wages and the time spent getting the money.

wannabestressfree · 23/06/2013 08:39

I have one from ICC when I was ticketed in a car park in London with my boot open whilst trying to move my sons belongings from his psychiatric unit.

I hope they do take me to court

sebastianthesingingaubergine · 23/06/2013 09:33

Mcnewpants2013, that argument doesnt hold up at ll. If it did they would put up the charges every time they took someone on. The court would look at the car park fee's and hence losses of landowner, not private parking companies costs.

If you are worried about what to do. Go to this site, the people there can advise you, (usually its ignore) but it may help put your mind at rest. They are up to date on current laws and many of their regular posters are legal bods with a specific interest in thwarting these private company sharks.

littlejo67 · 23/06/2013 10:40

Thank you for all your input it helping me to stay strong and ignore. The links posted have been very helpful.

Blissx - thanks for the kind words and the flowers.
Viva- wow that's a lot of tickets- glad its not been an issue for you.

I know the car park was free for two hours. I will have to go and check whether there was a fee after this time. I just assumed there wasn't. Technically if there was that would be the loses incurred. It would of been in the small print of the sign though as it 'clearly' states- parking for two hours free.

If you were on business at the GP's why not just ask them to get the ticket cancelled and then you don't need to worry about it?

juniper9 · 23/06/2013 13:24

I got a parking ticket from a similarly named company- don't know if it's the same thing.

They sent me threatening letters and I ignored, and they took me to sodding court. We ended up settling, on the proviso that I paid the original £60 for the fine. I still haven't so I guess I'm in contempt of court, but they haven't chased me on it and that was a year and a half ago.

I'm not going to name the company here as their solicitor turned up at court with a load of printed out sheets where they'd found me discussing the case on Martin Lewis and Peppido Hmm and I don't want them coming after me again!

I would advise you to post on peppido as they were brilliant with me- when I received my court summons, one of their members actually wrote my legal defence for me, just to help out.

I might have been able to win the case but I flaked at the idea of losing- I would have had to pay about £300 for it and I really couldn't afford to be a martyr.

If you want to pm me about it, and see if it is the same company, then please do. But do be careful with what you write online about it because they did google me and they did use my online posts in court.

Hopefully yours won't come to that. I think I was just exceptionally unlucky.

juniper9 · 23/06/2013 13:29

Incidentally, if this were to happen to me again, I'd do exactly the same thing. I wouldn't resp

juniper9 · 23/06/2013 13:31

*respond to them and I would definitely not pay.

My point is that they can take you to small claims court. The chances are incredibly slim, but it can happen. If you receive actual court summons, do not ignore! You'll get a ccj against your name, which affects your credit rating. I thought my court summons were just a joke so rang the court directly, not using the number on the letter. Turns out it was real.

gallifrey · 23/06/2013 14:09

sorry op I hope I didn't worry you that wasn't my intention.
It's just that there seems to be incorrect advice given all the time on parking threads, my dh is uk operations manager of a large parking company, he has set up parking enforcement at several places and he said that parking companies are within their rights to go to court to obtain money. However it is very rarely done but if they had a repeat offender then they probably would try and get the money.

EhricLovesTeamQhuay · 23/06/2013 17:18

Post on money saving expert. They will advise, and they know what they are talking about. If any of you have receipts for transactions whilst you were parked then a simple letter with a photocopy of the receipt should do. Courts won't find in favour of parking companies if you can prove you spent money while you we're parked.
Even if you don't have receipts - look on the forum. There is a very slim chance you could get taken to court and they advised me it was better to appeal immediately and save myself the potential worry, which I did, and got it written off with no argument.

Interesting, DH were discussing this earlier.

I saw a parking ticket on the screen of a car parked on a blue space, presumably without a blue badge permit.

The car park is a free car park, attached to a huge retail shopping centre.

Quite aside from the moral argument of not parking in a blue space, is the ticket enforceable?

Disclaimer: it was NOT my car, I promise.

gallifrey · 24/06/2013 08:40

Can I just add that my DH works for a reputable parking company that do not ticket cars that are parked in free spaces.

Deestar11 · 15/12/2014 21:50

ddubsgirl77 · 15/12/2014 22:40

We had a 'ticket' on windscreen the other day in brighton marina free car park it was early 9.30ish car park is free and max 4 hr stay we were 1.5 hr but due to having a large 7 seater and have already smashed a bumper before in that car park as its so old and not designed for the larger cars we parked in parent bay the car park was empty and still empty when we returned dh was really cross but as i told him the place isnt council land and not enforceable

frankie001 · 15/12/2014 23:06

I thought the advice had changed and that they are now enforceable?

GingerbreadPudding · 15/12/2014 23:07

I ignored one for ages despite threat of bayliffs and court action. It went away.

littlejo67 · 15/12/2014 23:35

Just to update this thread about the outcome. I continued to ignore their threatening letters of court fines etc. They gave up! I stopped hearing from them. So I would ignore again in the future they are full of cr*p.

Do NOT send a proportionate payment and say it's "in full and final settlement". It's NOT. They can accept the payment and come after you for the balance. All you have done by making a part payment is to admit liability.

I used to work for a firm who frequently got partial payments with letters sayimg this offer was "in full and final settlement" and if we banked it that was an end of the matter. We just wrote back saying we declined to accept the cash on that basis, banked the cheque and went after the balance.

Either pay the lot and end it or pay nothing and wait for them to go away. A part payment is the worst of both worlds.

DeeCayed · 16/12/2014 00:48

My dm has just received a letter from smart parking implying that they've already sent a first letter with 14 days to pay which she didn't get and this is the first she heard of any parking charge. Do they have to actually ticket the car? We don't even know what her offence was but I don't want her to ring them as I've told her to ignore them and di not pay!
