To dock a worker's pay for every penny they have cost my dad?

I have been left to run my dads building firm for the last month. Last week a member if staff TEXTED in claiming they had been admitted to hospital with laryngitis. I did not believe him and requested a ward discharge summary which he could not give me and then just admitted he had gone to A&E and did not go to the ward as the hospital had no beds. He was told a sore throat is not a valid reason for absence but he stayed off for the week. After returning he went AWOL for a day he claimed he had texted in but I never received it and when I asked him to produce the text off his mobile he claimed he deleted it. His messing around has lost the company £200. Should I dock it from his pay?

Roary - tread carefully. You are correct that with his length of service he woukdn't typically have the right to claim unfair dismissal; however if you dock his salary and he protests and you dismiss him around the same time, he could make a case that he was dismissed for asserting a statutory right (not to have his pay docked) and there is no qualifying period. Personally, I would just dismiss him and have done.

You sound immature and power mad. He may not take you to a tribunal - but if he did , it wouldn't be pleasant for you .

You've conducted a formal investigation and a disciplinary interview with him on this, then? And issued a written summary/outcome?

Do you have any HR / legal advice from someone who knows what they're doing at your disposal? Because sorry to be blunt, but you clearly haven't got a clue what you're doing & you're going to land your dad's company in a tribunal if you go ahead with your intended actions.

You don't sound very nice but I can see you are v. annoyed at this guy messing you about.
So, don't siink to his level, play by the rules.
You give him a formal written warning for damage to property.
Formal warning re sneaking fag breaks continuously
Formal warning for not following company procedures re illness.
Done!

Surely he can self certify sick for 5 days anyway, so no you cannot dock him that money. What is the procedure for reporting absence , is a text ever acceptable or an email perhaps (given he had lost his voice)?

You're not a dr, so have no place saying a sore throat isn't a reason for absence. That's just for starters.

A tribunal would have an absolute field day with you.

Settle down Beavis and engage your brain and company HR policy.

You need to behave professionally about this. At the moment you're just treating it emotionally and it's inappropriate. For a start you seem to have lost your temper over this far more than is necessary.

And I would be careful, other members of staff are going to see how you treat this guy and if you just lose the plot at him and start being vindictive towards him (and vindictive is exactly what you are being) other members of staff are going to see it and think if that's the way the wind is blowing when your Dad is off they'll take their work elsewhere.

If his employment contract says he needs to adhere to a policy of telephoning by x time or whatever and he didn't do that that is one thing. You can go down a disciplinary procedure.

Or you can do what you want and fire him and then go and dress up as Alexis Colby.
