Why are ATOS doing this to people?

DH broke his arm in July. He developed CRPS during the time the pot was on and as soon as the hospital removed it. He was taken in to see a consultant and they told him it was second or third stage.
He has always worked but his job involved heavy lifting so he was signed off. He sees the pain clinic every week, his occupational therapist for mirror box therapy weekly and is seeing a counsellor weekly to help him come to terms with the chronic and constant pain he's in.
He has begged them to amputate and his GP has backed this request up but there is no guarantee that it would stop it could make the pain worse.
So if that wasn't enough when work stopped paying him we had to claim ESA. He has never claimed any out of work benefits since leaving school we did get WTC. Three weeks of claiming and they called him for a medical.
The woman who did it was very nice but basically said that they will probably think well he's got another hand that he can use so should go to work. It was all tick boxes that she filled in. She was sympathetic but it gets sent off and all they see is he has one bad hand not that he can't stay awake because of the medication he's on or that he can't fasten his own jeans up or go to school and pick his children up. He can't even sit down without rocking or standing up as pacing is the only thing that he can do when he's in so much pain.
She did seem interested in his mental health as his doctor has wrote he's suicidal and anxious :(.
I'm so scared they will stop his ESA we are hardly surviving as it is. All our WTC has stopped all our savings have gone I can hardly afford to feed us as it is.
I'm more scared the affect it will have on DH though he already feels like he is scrounging and people are looking down on him and if they say you're fit for work and stop his money he is going to spiral more.
I can't even support us we have a toddler and 3 older dc and he can't look aftert them he can't cook, he falls asleep randomly, he can't clean up the toddler if she has an accident. I can't even work nights if there is an emergency and he's on all his painkillers wtf would happen.
But atos isn't interested I've read so many horror stories lately and I can't believe that they are leaving people to starve and die because they've ticked a box that says they can lift a hand above their heads or are ok answering a phone to a stranger.
His consultant and GP and psychologist have wrote letters supporting him yet someone who probably isn't even a doctor has our life in their hands right now. I've read stories where people have taken evidence in like blood test results and scan pictures and still are declared fit for work.
Why are they doing this to people who need the pat help? I've also read today that legal aid is stopping when it's a benefit issue so thousands of people are trying to defend themselves against these massive organizations.
It just doesn't seem very fair.

It must be terrifying, I'm very sorry. I do hope ATOS see sense and take his pain, his emotional and psychological state into account. Apparently 40% of appeals are successful, which doesn't give you much confidence in their decision making...

Sorry, what is 'ATOS', 'CRPS' and 'pot'. I'm thinking pot might be slang for a cast?

Thank you. People are saying more appeals are winning. But they put you on a lower rate while you do appeal. Its just all a bit pants.

OP have you got a local welfare rights agency that can help you with the appeal?

The rate of success at appeal, for people who use them is 60%.

They base your whole appeal on the scoring system that they go through with you, as long as the medical information matches what you tell them, the aeard is given.

Sorry pot is slang for cast. Think everyone in Yorkshire uses pot.
CRPS is chronic regional pain syndrome it occurs after a small injury and our brain thinks it hasn't healed and causes chronic pain and eventual deformity.
ATOS do medicals for the government to decide who is fit enough for work. Except they are finding people who are terribly Ill or disabled fit for work and use staff who have little medical training.

Thanks careergirl, I've never heard of ATOS. Or crpd for that matter.

It sounds like an awful situation - it must be severe before he would prefer amputation.

It's not over yet though. Here in Scotland CAB help with appeals for things like this, it might be worth getting in touch with them if they do decide he is fit for work. In the meantime, try not to worry, try and stay positive. Easy to say I know, but worrying never solved a problem.

It is bad. He describes it as having constant burning in his arm I've never seen him cry before but now it is almost daily. Our world is upside down and I just think if maybe they used common sense instead of tick boxes we might be a bit less scared of having this safety net pulled away from us.
I tried to explain to the Person doing the medical that he was a danger to himself and the children if I left him alone but she wasn't interested in that just if he answered the door or if it made him anxious in doing so.

If you are refused, PLEASE go to CAB for help with the appeal. They will also be able to advise if you are entitled to any other benefits and can help you fill in the claim forms, which I would recommend as they know the "keywords" ATOS, DWP etc. look for.

Thank you all for links and advice will keep thread to check them all. It is just little things that make you feel worse, such as the receptionist shouting out all her requests she wanted him to sign a form and he asked if I could fil it in for him as he can't write and she shouted so loudly "what you can't write at all?".
He can write and is very good at it his hand won't let him use a pen at all. FFS it's just seems to be all set up to make up feel as shitty as possible. Of course he asked to get an incurable condition that is just going to get worse. He deserves all this stress. Grrr.

(To answer the thread title - because there are people out there who frankly take the piss & having GPs as the benefit-police is potentially destructive to their relationship with patients/takes time away from medical services they should be providing/sanity-doctor-retention-issues! So something more external and ideally more consistent is needed...)

But I'm sorry to hear the stress you're going though. Sounds like you've collated what you can from the various professionals involved - so I'd keep organized with that, try to engage with any occupational health assessments and as other people have said try the appeal approach & sources of help with this like the CAB.

I have no answers but you have all my sympathy. You have to appeal if you get the wrong decision, so many are successful.

I would just say please don't consider amputation with crps, I'm no expert, but everything I've heard about that is that it makes things worse. I had a friend with crps, it's supposed to be one of the worst pains you can have, I'm so sorry for your husband and glad at least he has some support, even if that doesn't help much.

supportive thoughts for you!

some have found, if things seem to be going awry, that getting your mp to make enquiries has a remarkably speedy and positive effect. also radio 4s moneybox programme. but things might go ok with ATOS.

you probably should mention your levels of anxiety to your gp. you are under a lot of pressure.

Having just been to appeal (and won) with dh, I have every sympathy for you. Please try to get some help via Citizens Advice.

this place is good although you they ask for a small fee for the more detailed stuff.

To answer the thread title in another way - because they can. and have a government mandate to behave like utter, utter arseholes.

People making the decisions aren't even medically qualified. What does that say about the decisions - also they will frequently ignore, or misrepresent what the nurse or doctor doing the assessment has said.

Some of the doctors doing the assessments are incompetent (I know this from close experience, the assessment in question was overruled as it made zero sense, and was done again)

Yes DO appeal, a social services benefits advisor/advocate will be great if you can get hold of one.

But obvs I hope you do get it allowed, and don't have to go through the appeal process. Which is not that bad if you do, but still - more hassle than you need.

If you need help with it all, ring the county council and ask them for their social services dept, they might be able to help...their people do tribunals regularly and know what's what.

OP it will be worth speaking to the CAB and also checking if your DH is eligible for DLA as it sounds like he has care needs if he needs help dressing and you can't leave him on his own. He can get DLA as well as ESA.

if cumbags succeed in forcing your fella of said benefit i would expect he is entitled to jsa/income support,he should be intitled to some support.As i am in much same situation as him ,it may be worth pointing out that most companies have a question re ones health, and how the hell do they expect any Co. to offer to employ anyone currently receiving medical treatment ? I have informed these people? that i will return to jsa if and when they send me a letter accepting legal responsibility re my health and end result of myself having a major stroke whilst in any employment i can obtain>told i am ok to work whilst the so called doctor had not one sentence let alone file re my current health situation>and here it comes>>> why? so Diamond Dave can convince voters that all people on any kind of benefit is actually a Skiver an is wasting YOUR tax contributions! >>> switches on 50"flat screen tv and flicks thru holiday brochures .
