Brand new GHDs broken

I'm quite upset as they were a birthday present.

The store won't refund them and say I have to contact GHD directly - any advice?

I was assuming they were broken when purchased and have never worked?

The contract with the store is with the person that bought them, so they are within their rights not to discuss it with you. While normally I would say get thd buyer to speak to the shop, GHD are really good to deal with and you may well be better off talking to them directly than getting the purchaser to talk to the shop.

Whoops - sorry! Messed up my post.

They were bought on Saturday so literally brand new, I'd only used them once.

The store have said I need to register the GHDs online and to sort it with them Sad but I'm going to a wedding on Saturday and really wanted to use them (vain, I know.)

No you don't have to do it through GHD if you don't want to. The only way that you have the right to talk to the shop directly though is if the person that bought them made it clear it was for a gift at the time.

Under the sale of goods act they are not fit for purpose.

Tell them you will go to trading standards if they don't help.

BUT if the buyer didn't say they were a gift, they are within their rights not to deal with you, and deal with the buyer instead.

No, they were bought as a gift but I bought them Blush (DH hates shopping ...)

Oh well, then you are ansolutely in your rights to go back and ask for a replacement.

Legally they can offer a replacement, refund or repair.

I think it would be unlikely a repair would be offered for ghds though.

Tell them your contract is with them, the retailer, and not the manufacturer.

I would go with the online warranty registration as well as dealing with the retailer who legally must give a refund or replacement item. The reason I would register the product online is because GHD products have to be one of the most copied and forged items ever bought, the pages of ebay are full of fake GHD items sold by companies/sellers claiming they are the real item.

Yes, quote sale of goods act, not fit for purpose. They must exchange or refund you.

Skateboarder yes, I went back to the store yesterday and got told I needed to contact GHD and there was nothing they could do Hmm

Well - go back tomorrow and tell them that under the Sale of Goods Act you are entitled to a full refund and that if you don't get one you will be going to Consumer Direct. Your contract is with them - not with GHD

Although you are being advised to go back to the retailer, Ghd customer service is amazing. Go to their website and fill in a return form stating where they were purchased and what the problem is and I guarantee you they'll send you a new pair within the week.
