to be shocked and confused that no income or only C/B = no entitlement to C/T or H/B help?

I hate the word entitlement before I get screamed at, but that?s the official language being used.

You have ?entitlement? and get help, or you ?don?t have entitlement?, and don?t get help, and it?s all judged on income.

But child benefit is disregarded as income, and therefore if that is all you currently have, there is no income and therefore no entitlement to help.

So if a person has no current income other than child benefit, they can?t get help to pay rent or council tax, and will get evicted if they can?t sort out an income from somewhere in time, and build up a debt of unpaid council tax in the meantime.

Is it an individual council choice or the same everywhere?

Did I understand right that DLA on it?s own if awarded, would also be disregarded as an income? (head spinning and don't want to ask any more)

Am I stupid to not know this and be reeling?

Sorry that turned into a bit of a rant.

If I said he's hoping to go to uni, if he can get the grades which fluctuate wildly from A* to U without rhyme or reason, but it has to be from home because he can't fully bath unaided, or dress appropriately for task, season etc, and he will need his route and travel system to be quite inflexible, but knows to cover and you wouldn't find that out from just interviewing him, it would describe the extremes.

ok unless they have changed the wording since i last checked according to tc own regs a child is entitled to the disabled element of tc if they recive or are entitled to the highest care componant of dla. it is possible they have changed it but a look into the compliance will help. i cant look for you at the mo as my lo is sucking my nose and twisting my eyebrows easy to type but not so much to read Grin

i cant link at the mo but google tax credit claiment compliance staff manual it will find you the online actual manual give it a read its seriously helpfull

as to the asd i do understand exactly what you mean i have 5 asd kids one of mine sounds very simmerler to yours, everything you have put in your post is evidence of his differculties you can write everything like that in additional info on the dla form using additional sheets of paper if needed,you can also attend any appoinments with him and give input into them for benefit issues talk to dla explain all of this to them.

Wow, thank you so much (sorry about nose and eyebrows) have found what may be it but may be client compliance only, but thank you very much, I had no idea these things where in the public domain.

If you're right and they have changed the wording, it will be worth me finding out when, as, there's no question he would have been 4/5 years ago, when he was the gap between age and skills was even wider, which is when they're clawing back from.

that the one client compliance i allways get the client/claiment mixed up.
its in the public domain because the freedom of info act says they have to put it there.

a few bits get left out due to protection from fraud issues (its exempt from the act if it will teach you how to commit fraud) but every single benefit staff manual has to be made availible.

if you can try and also read the section on appeals/claw backs/over payments im certain it will help you

I think my ability to commit fraud may be compromised by my inability to manage a basic claim without getting into problems.

closest I've found so far is;

'A child or qualifying young person is disabled, or severely disabled, if he satisfies (a) prescribed conditions or
(b)prescribed conditions exist in relation to him.'

but haven't yet found what those conditions are, but I can see I'm going to be reading a lot. Thank you.
