Recently bought an item of clothing off ebay and it has arrived today and smells strongly of smoke. I contacted the seller and complained and she has written back to say that although it is unfortunate that I am unhappy there is nothing she is prepared to do.

Her stance is that nowhere did she state on the advert that the item was coming from a smoke free home and, having checked, unfortunately this is true. She believes that if I had a problem with an item smelling of smoke then I should have looked for auctions specifically stating "smoke free home". I want to open a dispute but not sure if she is right and it is my fault for just assuming it would be smoke free! AIBU?

YABU - If the ad didn't state smoke free home you could have asked the seller prior to purchase. You could wash the item to remove the smokey smell.

Was the item as described? If so then I don't think you can't open a dispute

Unfortunately she is right but it is beyond belief that anyone would sell an item of clothing without washing it ????

imnotmymum it might have been washed, but if it is hanging around a smoker's house it will still stink

I usually email the seller to check if it doesn't specify smoke free in the ad.

At least if it's clothing you can clean it easily enough, just be relieved that you learnt the lesson on something like that rather than something which can't be washed!!

I will wash it, I just thought that if it was a smoking home then it would have arrived washed or at least febreezed! It is otherwise as described so i'll shut up and accept i'm unreasonable.

Right this one off, wash it and hang it outside for a really good airing.

I had similar issue with one of those pull across fabric baby gates, it didn't say smoke free but was heavily stained and stank. I used lemon juice and left it outside the smell and stains lessened with a bit of effort. I didn't think to search for smoke free listings!

You are entitled to return it for a refund, but at your expense. If she says no, she's talking bollocks, check the Ebay help pages.

I'd never sell an item of clothing on Ebay without washing it first (and state in my listings that all items come from a smoke free home, which is true). Not do a 'lie of omission' is pretty shitty, IMO.

Send it back. Or leave her negative feedback, that'll hurt her future listings. Grin

You can't open a dispute because you didn't check it before buying!
I know it is irritating but wash it or get it dry cleaned. Yabu.

Wash it and be grateful it doesn't stink of some revolting cloying sickly sweet perfume used to try and mask the smell of smoke. I've washed a cardigan four times so far and I can still smell the perfume. Angry

Complete non issue, surely you'd wash any item of clothing bought from eBay anyway? I know I would? Particularly if it's not packaged as new/shrink wrapped or if it is used clothing.

I've had this before, it's dissapointing but I think she's right. I'm now very careful to check wIth the vendor if 'smoke free home' is not on the listing.

YAB a bit U to expect anything.

It most likely has been washed. A dress hung in a wardrobe in a house where people smoke indoors will smell of smoke.

Agree with what everyone has said above. Unfortunately I don't think you can do anything about it. Wash it, chalk it up to experience and leave her negative feedback

The seller might not have even realised it smelt of smoke - smokers don't always realise how bad their clothes and houses reek.

Trills - if the item HAS been washed, and I suspect it hasn't, then that's even worse. So Thyme will have to stink of smoke if she wears it?

I don't think YABU OP, still think you've got 2 choices:

  • Wash it, if the smoke comes out fine, but when you leave her feedback I'd leave it as neutral and point out it stunk when it arrived
  • Return it (but you'll need to pay the P&P)
  • If the smell doesn't come out, leave her negative feedback.

The reason sellers like that get away with it is because buyers don't leave proper feedback - you could be saving future buyers of her stinking clothes!

You are within your rights under the selling acts to request your money back for item not as descibed. Put it to a dispute but you will have to send it back recorded at your own expense

Just got a double pushchair off ebay for a friend and it also stinks of smoke, was really hacked off but accept there isn't anything I can do..
Sorry, slightly off track but wondering if lemon juice would work on maclaren pushchair too, or if anyone has any other tips?!
