AIBU re: this ebay item?

Recently bought an item of clothing off ebay and it has arrived today and smells strongly of smoke. I contacted the seller and complained and she has written back to say that although it is unfortunate that I am unhappy there is nothing she is prepared to do.

Her stance is that nowhere did she state on the advert that the item was coming from a smoke free home and, having checked, unfortunately this is true. She believes that if I had a problem with an item smelling of smoke then I should have looked for auctions specifically stating "smoke free home". I want to open a dispute but not sure if she is right and it is my fault for just assuming it would be smoke free! AIBU?

Nini - no. I'm not saying that it has permanent smellyness, I'm saying that it re-acquired smellyness.

It has been washed, then sat around in a smoky place so it got smelly again.

If you wash it again, the smoke smell will go again.

flippin heck...just wash the thing...I can't really understand the issue worth posting about tbh...

If you go to a BBQ you might smell of smoke...do you post about friends smelly BBQ after???...of course not...you can walk through a department store's perfume range and pick up a smell along the way...does anyone complain?...no!!

the item is as described but has a smell...anyone would wash/clean a 2nd hand item before wearing/using anyway....what's the issue...really???

I've been caught out like that before. Now I always check it's smoke free. Despite people stating the obvious eg. wash it, I have always found that even after 2 or 3 washes the smoke still stinks!
