compensation claim

my 4 year old child has fell at school and broke her nose,every1s telling me to claim compo, should i or not?

To have a cause of action there needs to be a breach of care that results in the accident. So, if the playground is uneven and your daughter tripped as a result there may be a cause of action. If your daughter just fell over, I don't see what the school did wrong that resulted in the accident and gives you good grounds to sue. If the school didn't react to the incident and the damage is greater than it would have been had they e.g. taken her to the hospital straight away, there may be a cause, but I doubt it. Just because she fell over and no adult was present, which I find hard to believe, doesn't mean you have a case. But by all means see a solicitor

Do all the other people that spend their day watching no win, no claim ads on daytime telly advising you to pursue this claim realise if you score a payout their kids will have fewer books, computers, trips and less sports equipment.

I take it you also realise that if you receive a payout the solicitors involved will retain at least half.

If you can actually envisage yourself actually going to the school to make this claim, and if you can envisage facing the other pupils and their parents if you pursue your claim then by all means go ahead.

But consider this, a lot of people on here you don't know are scathing of the plan. Imagine the vitriol in real life.

If the school needs to change its policy fine, you've spotted an issue that is in everyone's interest to have resolved. To pursue a claim would be selfish in the extreme since a bashed nose on a 4 year old is unlikely to cause major ongoing health issues.

In 15 years as a doctor, 8 of them in A&E, I have never seen a 4 year old with a broken nose.

I'd imagine what they said to you was more 'nobody was near enough to see what happened' rather than 'nobody was in the playground'

When you say others are telling you to sue the school, would this be on a FB status by any change Hmm
