would it be illegal to get CB paid to my ex?

just a thought.

I have 2 DC from my previous marriage and one from my current one. Could I ask my ex to have CB paid to him so DH doesn't get clobbered on tax because I receive CB for MY 2 DC?

I'm a bit Hmm at the point that as the OP lives with her DH who is not the biological parent of her child she should still get CB. Surely if they live together there is an element of shared parenting and therefore shared financial responsibility too? So his salary benefits her dc and as a HOUSEHOLD they are assessed for tax/CB/whatever purpose?

That's not how welfare states work - they work by giving everybody a stake in state benefits.

The US is a country that just focuses on giving handouts to the worst off.

It's not a welfare state, and every penny the poor get is begrudged.

Your argument is that we should dismantle the welfare state, remove all universal entitlements and then concentrate our resources on the indigent.

If starving is your benchmark for receiving state help, then presumably anyone on a salary above around £15,000 should lose CB.

And presumably pay for their own health insurance. Why should the state pay for wealthy people to see the doctor? Hmm

So you want your ex to contact HMRC, lie to them about being the main carer of your DC and then hand over his fraudulently obtained money to you, when your DH has a higher income than him anyway?

I'm sure he'll be thrilled about that.

So this is about your DC not getting CB but DSD receiving it? Can you not see, DSD household income must be much lower than yours. So its lifting her slightly closer to your DC income rather than your DC loosing out against DSD.

From Direct.gov:

"You can get Child Benefit even if your child doesn't live with you, as long as:

1 you pay towards their upkeep

2 what you pay is at least the same amount as Child Benefit

3 the person your child lives with is not getting Child Benefit for them"

So it looks like you are right, OP - CB can be claimed for your children by their father, as long as he pays more than that to you as maintenance.

Not fraud at all!

Er no it's not! I haven't said I agree with these criteria! I am just sick of hearing people on a household income over £60k moaning about losing a benefit they don't really actually need.

Slightly different take! I will lose my CB. My knobhead of an ExH who's probably paid 6 CSA payments in 6 yrs rang me to ask if I would transfer the payment to him!

that's exactly what we don't want to do, differentiate between any of the DC. A drop in income may mean that they all miss out on activities (which cost £5phpc max btw). I fully accept that the dc dh and I have 'together' we will lose most of the cb for, but if we can legally avoid losing cb for my dc, why wouldn't we?

but OP will your children gain? EX doesn't have to give you the money as long as your maintenance is currently at that level, will EX offer the money to pay for the activities?

Your envy and spite is quite evident.

It is in appealing to that kind of nastiness that the whole thing will be dismantled.

CB was money given to all families with children, to help them pay the increased costs of raising children.

It is one of the most successful and cheapest benefits, and you are happy to see it gutted to satisfy your vindictiveness.

Well done. The next time they remove lots of families from the benefit, it will be easier to do.

When they abolish it, the only people who will care will be the ones with no power.

These HRT you despise so much pay in more to the state than they take out. But you want to take away any stake they might have in paying taxes for benefits. Very farsighted of you.

If this is legal then it will work out for people like the OP who have a reasonable relationship with the NRP, but not for others.
