Exactly. Not read article but surely by having them both at once they only need to hire one replacement and then she'll be back working for them without interruption? Hmm

Glad she took them to court, it is illegal after all, isn't it?

I cant the compensation culture but I agree with this. After DD2 I returned to work already expecting DC 3 and was really worried about telling my boss. He gave me a big hug and said congrats with a massive grin.

I truly believe this employer would have got away with making her redundant had he not:

  • told a colleague that he would rather make someone redundant rather than pay them maternity leave

  • Not paid her a bonus whilst on maternity leave and given her misleading information regarding bonus.

ALthough this employer is certainly unfair it isn't unfair to make a pregnant woman redundant if there is a strong business case regarding the role in question.

Clearly on this occasion there didn't seem to be.

TBH what did she expect?

She wanted a year off for each child, with just four months of work in the middle. Even though legally within her rights, she was pushing her luck.

The manager handled it badly though. He made it personal rather than just about the business case for redundancy.

Of course the court agreed - it could do little else due to the actions of the manager. Any genuine business case (an employee not being available to a small company for 2.5 years is a genuine case) was undermined.

Perhaps if she promised to come back a bit sooner the employer might have been more understanding. But another year? She was taking the piss.

It appears she was within the law, however her actions will have ramifactions for all women of child-bearing age attempting to gain employment with a small employer.

Being entitled to bonus' is just fucking absurd though!

Mrs Scott was entitled to all her staturtory rights by law. Get over it. The same thing has happened to me & I intend to take it all the way on principle. I have been discriminated against beacause of the fact that I dared to start a family & I have not taken kndly to it, thank you! My 17 year career has been ruined because of this, it is so hard to get a job in the same field which will fit around my childcare that would be in place now. I am however enjoying my children, so it is not all bad.

She lives about 5 minutes away from me and the general consensus is that she did the right thing! But the talk in my local, where alot of uber rich business owners drink is that she was taking the piss and "there should be laws against it". One of them is the super rich owner of a multi-national that everyone has heard of and he was ranting about how much "selfish fucking breeders" cost his company. Easy for him to say, his first and second wives (left the first for the much younger second...you get the picture!) were both happily esconsed at home when they were having his kids!

how can you expect to be paid a works bonus if you did not actually work - if it was written into the contract then the firm needs to employ a better company secretary

I agree cat64, nor do I think women on maternity leave should be paid holiday pay. Surely you have to work to accrue holiday?

However, I support this woman in her compensation claim. I hop her "five figure payout" was nearer £99,999 than £10,000. Only punitive compensation will make these twats think twice about breaking employment law.

If you're on ML you're entitled to the bonus that everyone gets as a result of sales figures overall (if that's the basis bonuses are given on). Nothing to do with needing a better company secretary - I worked for a massive global accountancy firm and those were the rules there too
