to think this man was bloody rude...

sitting in a bus shelter were; a mum with a tiny baby in a sling, a mum with a toddler and a 6ish mo in a buggy, a heavily pg woman with a toddler and an elderly couple, there's a seat free in the middle of everyone in the little shelter. Along comes a young man, he sits in the spare seat and proceeds to light a cigarette. pg woman asks him if he could please smoke away from the shelter, he says in a confrontational way 'if you don't like it you can move, I'm allowed to smoke here'

he smoked the rest of his cigarette sitting down in an empty shelter.

I actually thought the rule was that smoking was not allowed in areas that are more than 50% enclosed. So a bus shelter with just one wall on the long side, and a roof, is more than 50% enclosed because the floor counts. A bus shelter with more than one wall is very definitely more than 50% enclosed.

I think I was told this by someone who was in the building/architecture, but might have remembered wrong.

Think Deliaskis is right, depending on the bus shelter, it can be illegal. Thought that a typical bus shelter ? two or 3 'walls' supporting a roof ? will be considered a 'substantially enclosed' premises, therefore smoking illegal there.

I live in the west of Scotland and bus shelters here are non-smoking too.

IIRC Deliaskis is correct and if it was more than 50% enclosed it counts as an enclosed public place and smoking is not permitted (I had to study the legislation when it came in as I was in charge of putting up signs everywhere it applied at my workplace).

Legal or not he was still being really rude; I have smokers in my family but they would NEVER act like that, no matter how desperate they were for a fag.

Whether he was allowed to or not, it is inconsiderate and rude to do something that adversely affects other people - and especially when they are vulnerable in some way.

Bad behaviour. No reasonable person would smoke next to a baby etc. He should have stood outside.

why was he in the wrong? he smokes so obviously agrees with it, if you have the problem you should move. Its not his fault you are pregnant

Smokers know that the time spent waiting for a bus is a prime fag break opportunity. However, they will have to be more selective in where they stand after the ban as the typical bus shelter ? two 'walls' supporting a roof ? will be considered a 'substantially enclosed' premise.

That's not to say all bus shelters will be out of bounds for smokers. The actual definition laid down in the smoking ban legislation defines a building as 'substantially enclosed' if it has 'a ceiling or roof, but has an opening in the walls, which is less than half the total area of the walls. The area of the opening does not include doors, windows or any other fittings that can be opened or shut'.

It means it is perfectly legal to smoke in a bus shelter with a roof supported by just one vertical 'wall', rather than two. Smokers may find this useful knowledge if confronted by hostile non-smokers.

So if it had 3 wall it was illegal & he was extremely rude. I smoked until quite recently but always made a point of standing away from the bus stop even if there were no kids or pregnant women there. Its common decency isn't it?

NordicPrincess - he is in the wrong because his behaviour, legal or not, is adversely affecting a number of people. Do you go out in public and deliberately upset people, just because you can?

I very much doubt it - so what's wrong with standing BESIDE the shelter and blowing your stinky smoke away from the non smokers.

Shineon it IS illegal to smoke in the type of bus stop the OP described. Nothing to do with being viewed as scum. My DP smokes & I did until I found out I was pregnant. It just comes down to whether or not you are an inconsiderate idiot, neither of us would dream of being this rude but that's because we have a certain amount of respect for other people.

It's not allowed in the shelters near us. But if someone sparks a fag up then I move. It's my problem with the smell/the passive smoking my children have to endure. I'd rather not have the hassle of an arguement. It's easier to just shift my arse.

I was just pointing out that you had said he was allowed when it is in fact illegal to smoke in that type of bus stop. Whether or not you don't have a problem with it it's still against the law. And in case you were offended by my inconsiderate idiot remark it was aimed at him not you, thanks for being rude about the name though.

It's just a pity that the words 'do you mind if I smoke?' seem to have passed from public usage.... Courtesy costs nothing.

MaMoTTaT has a point, think the shelter would have been covered in signs if it had actually been illegal .

Considering the bunch he was joining in the shelter I think maybe he was having a little wager with himself on how long it would take for someone to tell him off.
