Dd reported for assault

Someone through a cup of water at dd’s uni accommodation door. She then saw the person and throw water over them is this assault? Even when provoked

I wouldn’t be supporting my daughter to manage this situation, I’d be telling her to grow up and that “ongoing dispute” or not, handle yourself better.

Doesnt matter if she was provoked. The other person only threw water at a door (criminal damage at the very worst)

Throwing something at a person is considered common assault or battery.

It is assault.

I’m aware of the police filing charges after a Court officer witnessed a person at Court throw a drink of flavoured milk over someone they hated who was also present at Court.

The Police dropped the charges - even though there was a witness.

You need to have a conversation with your daughter about when and when not to react and also to never speak with the Police.

You may need a lawyer to get the charges dropped.

If my DD had been the “victim” in this I’d be more likely to say to her, now what have we learned from this, and push for them to go to mediation.

Of course I have no idea whether the “victim” or the OP’s DD or both are thuggish types that are not to be reasoned with. But I’d say they both need to grow up and learn to get along with other.

I'd get your daughter moved out of her accomm. and into another. Sounds as if this will just perpetuate otherwise. The other person will likely prod until he/she gets another rise.

This is assault. We had police involvement after my son was beaten by another boy at school. It transpired my son had instigated the incident by throwing water at the other boy first. The police explained to my son he had also committed assault, in fact they told him that if you throw an object at another person even if you miss, if the other person feared the object would hit them then that is also assault.

Ultimately no police action was taken against either of them

This can't have come out of nowhere.
In any case, your daughter threw water on a person. That person had only thrown it on your daughter's door.

If it’s a first offence it’s basically just a caution.
